| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 1362.003(b), Insurance Code, is amended | |
| 11 | 11 | to read as follows: | |
| 12 | 12 | (b) Coverage required under this section includes at a | |
| 13 | 13 | minimum: | |
| 14 | 14 | (1) a physical examination for the detection of | |
| 15 | 15 | prostate cancer; and | |
| 16 | 16 | (2) a prostate-specific antigen test used for the | |
| 17 | 17 | detection of prostate cancer for each male who is 40 years of age or | |
| 18 | 18 | older[: | |
| 19 | 19 | [(A) is at least 50 years of age and is | |
| 20 | 20 | asymptomatic; or | |
| 21 | 21 | [(B) is at least 40 years of age and has a family | |
| 22 | 22 | history of prostate cancer or another prostate cancer risk factor]. | |
| 23 | 23 | SECTION 2. This Act applies only to an insurance policy or | |
| 24 | 24 | contract or evidence of coverage that is delivered, issued for | |
| 25 | 25 | delivery, or renewed on or after January 1, 2010. An insurance | |
| 26 | 26 | policy or contract or evidence of coverage delivered, issued for | |
| 27 | 27 | delivery, or renewed before January 1, 2010, is governed by the law | |
| 28 | 28 | as it existed immediately before the effective date of this Act, and | |
| 29 | 29 | that law is continued in effect for that purpose. | |
| 30 | 30 | SECTION 3. This Act takes effect September 1, 2009. |
