| 8 | 8 | | relating to the investigation and prevention of drive-by shootings. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 1701.352, Occupations Code, is amended |
|---|
| 11 | 11 | | by adding Subsection (g) to read as follows: |
|---|
| 12 | 12 | | (g) The commission shall require each peace officer to |
|---|
| 13 | 13 | | complete, at least once every 24 months, an education and training |
|---|
| 14 | 14 | | program relating to the investigation and prevention of drive-by |
|---|
| 15 | 15 | | shootings. The commission shall develop learning and performance |
|---|
| 16 | 16 | | objectives for the education and training program required by this |
|---|
| 17 | 17 | | subsection. The commission shall administer the education and |
|---|
| 18 | 18 | | training program or certify other entities to administer the |
|---|
| 19 | 19 | | program. In developing the learning and performance objectives |
|---|
| 20 | 20 | | required by this subsection, the commission shall: |
|---|
| 21 | 21 | | (1) determine the appropriate number of hours to |
|---|
| 22 | 22 | | require for the education and training program; and |
|---|
| 23 | 23 | | (2) define the term "drive-by shooting" and the |
|---|
| 24 | 24 | | offenses included in that term. |

| 25 | 25 | | SECTION 2. (a) The Commission on Law Enforcement Officer |
|---|
| 26 | 26 | | Standards and Education shall develop the education and training |
|---|
| 27 | 27 | | program required by Section 1701.352(g), Occupations Code, as added |
|---|
| 28 | 28 | | by this Act, and ensure that the program is available not later than |
|---|
| 29 | 29 | | January 1, 2010. |
|---|
| 30 | 30 | | (b) A peace officer is not required to be in compliance with |
|---|
| 31 | 31 | | the training requirements of Section 1701.352(g), Occupations |
|---|
| 32 | 32 | | Code, as added by this Act, before September 1, 2011. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect September 1, 2009. |
