55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to continuing education and training for peace officers
88 relating to the investigation and prevention of drive-by shootings.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1701.352, Occupations Code, is amended
1111 by adding Subsection (g) to read as follows:
1212 (g) The commission shall require each peace officer to
1313 complete, at least once every 24 months, an education and training
1414 program relating to the investigation and prevention of drive-by
1515 shootings. The commission shall develop learning and performance
1616 objectives for the education and training program required by this
1717 subsection. The commission shall administer the education and
1818 training program or certify other entities to administer the
1919 program. In developing the learning and performance objectives
2020 required by this subsection, the commission shall:
2121 (1) determine the appropriate number of hours to
2222 require for the education and training program; and
2323 (2) define the term "drive-by shooting" and the
2424 offenses included in that term.
2525 SECTION 2. (a) The Commission on Law Enforcement Officer
2626 Standards and Education shall develop the education and training
2727 program required by Section 1701.352(g), Occupations Code, as added
2828 by this Act, and ensure that the program is available not later than
2929 January 1, 2010.
3030 (b) A peace officer is not required to be in compliance with
3131 the training requirements of Section 1701.352(g), Occupations
3232 Code, as added by this Act, before September 1, 2011.
3333 SECTION 3. This Act takes effect September 1, 2009.
