6	6	AN ACT
7	7	relating to the use of motion sensor technology in certain state
8	8	buildings, public school facilities, and higher education
9	9	facilities.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Subchapter A, Chapter 2165, Government Code, is
12	12	amended by adding Section 2165.012 to read as follows:
13	13	Sec. 2165.012. USE OF MOTION SENSOR TECHNOLOGY IN STATE
14	14	BUILDINGS. (a) In this section, "motion sensor technology" means
15	15	technology that uses motion sensor devices to automatically control
16	16	a building's lighting, heating, ventilation, and air conditioning
17	17	systems based on the presence or absence of people.
18	18	(b) Not later than January 31, 2011, a state agency or
19	19	institution of higher education that has charge and control of a
20	20	state building that does not use motion sensor technology shall
21	21	retrofit the building with motion sensor technology. This
22	22	subsection applies only to a building that was a state building on
23	23	September 1, 2009.
24	24	SECTION 2. Subchapter I, Chapter 2166, Government Code, is
25	25	amended by adding Section 2166.407 to read as follows:
26	26	Sec. 2166.407. USE OF MOTION SENSOR TECHNOLOGY IN STATE
27	27	BUILDINGS. (a) In this section, "motion sensor technology" means
28	28	technology that uses motion sensor devices to automatically control
29	29	a building's lighting, heating, ventilation, and air conditioning
30	30	systems based on the presence or absence of people.
31	31	(b) This section applies to the construction of a new state
32	32	building and the acquisition of a building by the state, including a
33	33	building construction project otherwise exempt from this chapter
34	34	under Section 2166.003.
35	35	(c) During the planning phase of the proposed construction,
36	36	the commission, or the governing body of the appropriate agency or
37	37	institution that is undertaking a project otherwise exempt from
38	38	this chapter under Section 2166.003, shall include in the
39	39	construction plans for a new state building the use of motion
40	40	sensor technology.
41	41	(d) Not later than one year after the acquisition by the
42	42	state of a building that does not use motion sensor technology, the
43	43	state agency or institution of higher education that has charge and
44	44	control of the acquired building shall retrofit the building with
45	45	motion sensor technology.
46	46	SECTION 3. Subchapter Z, Chapter 44, Education Code, is
47	47	amended by adding Section 44.905 to read as follows:
48	48	Sec. 44.905. USE OF MOTION SENSOR TECHNOLOGY IN
49	49	INSTRUCTIONAL FACILITIES. (a) In this section:
50	50	(1) "Instructional facility" has the meaning assigned
51	51	by Section 46.001.
52	52	(2) "Motion sensor technology" means technology that
53	53	uses motion sensor devices to automatically control a building's
54	54	lighting, heating, ventilation, and air conditioning systems based
55	55	on the presence or absence of people.
56	56	(b) Not later than January 31, 2011, a school district shall
57	57	retrofit all instructional facilities with motion sensor
58	58	technology. This subsection applies only to a building that was a
59	59	school district instructional facility on September 1, 2009.
60	60	(c) A school district that constructs a new instructional
61	61	facility shall include in the construction plans for the facility
62	62	the use of motion sensor technology.
63	63	(d) Not later than one year after the acquisition by a
64	64	school district of a building to be used as an instructional
65	65	facility that does not use motion sensor technology, the school
66	66	district shall retrofit the acquired building with motion sensor
67	67	technology.
68	68	SECTION 4. Subchapter Z, Chapter 51, Education Code, is
69	69	amended by adding Section 51.9272 to read as follows:
70	70	Sec. 51.9272. USE OF MOTION SENSOR TECHNOLOGY IN
71	71	EDUCATIONAL AND HOUSING FACILITIES. (a) In this section:
72	72	(1) "Housing facility" has the meaning assigned by
73	73	Section 53.02.
74	74	(2) "Motion sensor technology" means technology that
75	75	uses motion sensor devices to automatically control a building's
76	76	lighting, heating, ventilation, and air conditioning systems based
77	77	on the presence or absence of people.
78	78	(b) Not later than January 31, 2011, an institution of
79	79	higher education shall retrofit all educational and housing
80	80	facilities with motion sensor technology. This subsection applies
81	81	only to a building that was an educational or housing facility of an
82	82	institution of higher education on September 1, 2009.
83	83	(c) An institution of higher education that constructs a new
84	84	educational or housing facility shall include in the construction
85	85	plans for the facility the use of motion sensor technology.
86	86	(d) Not later than one year after the acquisition by an
87	87	institution of higher education of a building to be used as an
88	88	educational or housing facility that does not use motion sensor
89	89	technology, the institution of higher education shall retrofit the
90	90	acquired building with motion sensor technology.
91	91	SECTION 5. This Act takes effect September 1, 2009.
