66 AN ACT
77 relating to the use of motion sensor technology in certain state
88 buildings, public school facilities, and higher education
99 facilities.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter A, Chapter 2165, Government Code, is
1212 amended by adding Section 2165.012 to read as follows:
1313 Sec. 2165.012. USE OF MOTION SENSOR TECHNOLOGY IN STATE
1414 BUILDINGS. (a) In this section, "motion sensor technology" means
1515 technology that uses motion sensor devices to automatically control
1616 a building's lighting, heating, ventilation, and air conditioning
1717 systems based on the presence or absence of people.
1818 (b) Not later than January 31, 2011, a state agency or
1919 institution of higher education that has charge and control of a
2020 state building that does not use motion sensor technology shall
2121 retrofit the building with motion sensor technology. This
2222 subsection applies only to a building that was a state building on
2323 September 1, 2009.
2424 SECTION 2. Subchapter I, Chapter 2166, Government Code, is
2525 amended by adding Section 2166.407 to read as follows:
2626 Sec. 2166.407. USE OF MOTION SENSOR TECHNOLOGY IN STATE
2727 BUILDINGS. (a) In this section, "motion sensor technology" means
2828 technology that uses motion sensor devices to automatically control
2929 a building's lighting, heating, ventilation, and air conditioning
3030 systems based on the presence or absence of people.
3131 (b) This section applies to the construction of a new state
3232 building and the acquisition of a building by the state, including a
3333 building construction project otherwise exempt from this chapter
3434 under Section 2166.003.
3535 (c) During the planning phase of the proposed construction,
3636 the commission, or the governing body of the appropriate agency or
3737 institution that is undertaking a project otherwise exempt from
3838 this chapter under Section 2166.003, shall include in the
3939 construction plans for a new state building the use of motion
4040 sensor technology.
4141 (d) Not later than one year after the acquisition by the
4242 state of a building that does not use motion sensor technology, the
4343 state agency or institution of higher education that has charge and
4444 control of the acquired building shall retrofit the building with
4545 motion sensor technology.
4646 SECTION 3. Subchapter Z, Chapter 44, Education Code, is
4747 amended by adding Section 44.905 to read as follows:
4848 Sec. 44.905. USE OF MOTION SENSOR TECHNOLOGY IN
4949 INSTRUCTIONAL FACILITIES. (a) In this section:
5050 (1) "Instructional facility" has the meaning assigned
5151 by Section 46.001.
5252 (2) "Motion sensor technology" means technology that
5353 uses motion sensor devices to automatically control a building's
5454 lighting, heating, ventilation, and air conditioning systems based
5555 on the presence or absence of people.
5656 (b) Not later than January 31, 2011, a school district shall
5757 retrofit all instructional facilities with motion sensor
5858 technology. This subsection applies only to a building that was a
5959 school district instructional facility on September 1, 2009.
6060 (c) A school district that constructs a new instructional
6161 facility shall include in the construction plans for the facility
6262 the use of motion sensor technology.
6363 (d) Not later than one year after the acquisition by a
6464 school district of a building to be used as an instructional
6565 facility that does not use motion sensor technology, the school
6666 district shall retrofit the acquired building with motion sensor
6767 technology.
6868 SECTION 4. Subchapter Z, Chapter 51, Education Code, is
6969 amended by adding Section 51.9272 to read as follows:
7070 Sec. 51.9272. USE OF MOTION SENSOR TECHNOLOGY IN
7171 EDUCATIONAL AND HOUSING FACILITIES. (a) In this section:
7272 (1) "Housing facility" has the meaning assigned by
7373 Section 53.02.
7474 (2) "Motion sensor technology" means technology that
7575 uses motion sensor devices to automatically control a building's
7676 lighting, heating, ventilation, and air conditioning systems based
7777 on the presence or absence of people.
7878 (b) Not later than January 31, 2011, an institution of
7979 higher education shall retrofit all educational and housing
8080 facilities with motion sensor technology. This subsection applies
8181 only to a building that was an educational or housing facility of an
8282 institution of higher education on September 1, 2009.
8383 (c) An institution of higher education that constructs a new
8484 educational or housing facility shall include in the construction
8585 plans for the facility the use of motion sensor technology.
8686 (d) Not later than one year after the acquisition by an
8787 institution of higher education of a building to be used as an
8888 educational or housing facility that does not use motion sensor
8989 technology, the institution of higher education shall retrofit the
9090 acquired building with motion sensor technology.
9191 SECTION 5. This Act takes effect September 1, 2009.
