55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to extension of water and sewer utility services to
88 certain public school facilities or hospital facilities to
99 supplement services provided by the holder of a certificate of
1010 public convenience and necessity.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter G, Chapter 13, Water Code, is amended
1313 by adding Section 13.258 to read as follows:
1414 Sec. 13.258. SUPPLEMENTAL SERVICES FOR CERTAIN PUBLIC
1515 SCHOOL OR HOSPITAL FACILITIES. (a) A retail public utility, on the
1616 request of a school district, a hospital, or a hospital district
1717 that has a facility located in the certificated area of another
1818 retail public utility and that is located within 100 kilometers of
1919 this state's international border, may extend water or sewer
2020 services to a facility of the school district, hospital, or
2121 hospital district to provide supplemental services that the
2222 facility may use at any time the services of the certificated retail
2323 public utility are interrupted or inadequate. A certificate of
2424 public convenience and necessity or an amendment to a certificate
2525 is not required for the extension.
2626 (b) The retail public utility extending services under
2727 Subsection (a) shall ensure that the water lines and other
2828 facilities the retail public utility connects to the school or
2929 hospital facility do not interfere with the ability of the
3030 certificated retail public utility to provide services to the
3131 school or hospital facility.
3232 (c) The retail public utility extending services under
3333 Subsection (a) shall provide written notice to the commission at
3434 the time services are extended.
3535 SECTION 2. This Act takes effect September 1, 2009.
