| 8 | 8 | | certain public school facilities or hospital facilities to |
|---|
| 9 | 9 | | supplement services provided by the holder of a certificate of |
|---|
| 10 | 10 | | public convenience and necessity. |
|---|
| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Subchapter G, Chapter 13, Water Code, is amended |
|---|
| 13 | 13 | | by adding Section 13.258 to read as follows: |
|---|
| 14 | 14 | | Sec. 13.258. SUPPLEMENTAL SERVICES FOR CERTAIN PUBLIC |
|---|
| 15 | 15 | | SCHOOL OR HOSPITAL FACILITIES. (a) A retail public utility, on the |
|---|
| 16 | 16 | | request of a school district, a hospital, or a hospital district |
|---|
| 17 | 17 | | that has a facility located in the certificated area of another |
|---|
| 18 | 18 | | retail public utility and that is located within 100 kilometers of |
|---|
| 19 | 19 | | this state's international border, may extend water or sewer |
|---|
| 20 | 20 | | services to a facility of the school district, hospital, or |
|---|
| 21 | 21 | | hospital district to provide supplemental services that the |
|---|
| 22 | 22 | | facility may use at any time the services of the certificated retail |
|---|
| 23 | 23 | | public utility are interrupted or inadequate. A certificate of |
|---|
| 24 | 24 | | public convenience and necessity or an amendment to a certificate |
|---|
| 25 | 25 | | is not required for the extension. |
|---|
| 26 | 26 | | (b) The retail public utility extending services under |
|---|
| 27 | 27 | | Subsection (a) shall ensure that the water lines and other |
|---|
| 28 | 28 | | facilities the retail public utility connects to the school or |
|---|
| 29 | 29 | | hospital facility do not interfere with the ability of the |
|---|
| 30 | 30 | | certificated retail public utility to provide services to the |
|---|
| 31 | 31 | | school or hospital facility. |
|---|
| 32 | 32 | | (c) The retail public utility extending services under |
|---|
| 33 | 33 | | Subsection (a) shall provide written notice to the commission at |
|---|
| 34 | 34 | | the time services are extended. |
|---|
| 35 | 35 | | SECTION 2. This Act takes effect September 1, 2009. |
