| 8 | 8 | certain times to persons enrolled in the Medicaid managed care | |

| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Section 533.01315(b), Government Code, is | |
| 12 | 12 | amended to read as follows: | |
| 13 | 13 | (b) The commission shall ensure that a federally qualified | |
| 14 | 14 | health center, physician office, rural health clinic, or municipal | |
| 15 | 15 | health department's public clinic is reimbursed for health care | |
| 16 | 16 | services provided to a recipient outside of regular business hours, | |
| 17 | 17 | including on a weekend or holiday, at a rate that is equal to the | |
| 18 | 18 | allowable rate for those services as determined under Section | |
| 19 | 19 | 32.028, Human Resources Code, regardless of whether the recipient | |
| 20 | 20 | has a referral from the recipient's primary care provider. | |
| 21 | 21 | SECTION 2. If before implementing any provision of this Act | |
| 22 | 22 | a state agency determines that a waiver or authorization from a | |
| 23 | 23 | federal agency is necessary for implementation of that provision, | |
| 24 | 24 | the agency affected by the provision shall request the waiver or | |
| 25 | 25 | authorization and may delay implementing that provision until the | |
| 26 | 26 | waiver or authorization is granted. | |
| 27 | 27 | SECTION 3. This Act takes effect September 1, 2009. |
