55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to reimbursement for health care services provided at
88 certain times to persons enrolled in the Medicaid managed care
99 program.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 533.01315(b), Government Code, is
1212 amended to read as follows:
1313 (b) The commission shall ensure that a federally qualified
1414 health center, physician office, rural health clinic, or municipal
1515 health department's public clinic is reimbursed for health care
1616 services provided to a recipient outside of regular business hours,
1717 including on a weekend or holiday, at a rate that is equal to the
1818 allowable rate for those services as determined under Section
1919 32.028, Human Resources Code, regardless of whether the recipient
2020 has a referral from the recipient's primary care provider.
2121 SECTION 2. If before implementing any provision of this Act
2222 a state agency determines that a waiver or authorization from a
2323 federal agency is necessary for implementation of that provision,
2424 the agency affected by the provision shall request the waiver or
2525 authorization and may delay implementing that provision until the
2626 waiver or authorization is granted.
2727 SECTION 3. This Act takes effect September 1, 2009.
