55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to exceptions to certain disqualifications from receiving
88 unemployment benefits.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 207.045(b) and (d), Labor Code, are
1111 amended to read as follows:
1212 (b) A [Except as provided by Subsection (c), a]
1313 disqualification for benefits under this section continues until
1414 the individual has returned to employment and:
1515 (1) worked for six weeks; or
1616 (2) earned wages equal to six times the individual's
1717 benefit amount.
1818 (d) Notwithstanding any other provision of this section, an
1919 individual who is available to work may not be disqualified for
2020 benefits because the individual left work because of:
2121 (1) a medically verified illness of the individual or
2222 the individual's minor child;
2323 (2) injury;
2424 (3) disability;
2525 (4) pregnancy;
2626 (5) an involuntary separation as described by Section
2727 207.046; [or]
2828 (6) a move from the area of the individual's employment
2929 that:
3030 (A) was made with the individual's spouse who is
3131 a member of the armed forces of the United States; and
3232 (B) resulted from the spouse's permanent change
3333 of station of longer than 120 days or a tour of duty of longer than
3434 one year; or
3535 (7) a move from the area of the individual's employment
3636 that:
3737 (A) was made with the individual's spouse who is
3838 not a member of the armed forces of the United States; and
3939 (B) resulted from a change in the location of the
4040 spouse's employment.
4141 SECTION 2. Section 207.045(c), Labor Code, is repealed.
4242 SECTION 3. The changes in law made by this Act apply only to
4343 eligibility for unemployment compensation benefits based on a claim
4444 that is filed with the Texas Workforce Commission on or after the
4545 effective date of this Act. A claim filed before the effective date
4646 of this Act is governed by the law in effect on the date the claim
4747 was filed, and the former law is continued in effect for that
4848 purpose.
4949 SECTION 4. This Act takes effect September 1, 2009.
