 A BILL TO BE ENTITLED
 AN ACT
 relating to notice of proposed increases in fees charged by the
 Parks and Wildlife Department for certain permits.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Chapter 43, Parks and Wildlife Code, is amended
 by adding Subchapter A to read as follows:
 SUBCHAPTER A.  GENERAL PROVISIONS
 [Sec. 43.001. Reserved]
 Sec. 43.002.  NOTICE OF PROPOSED PERMIT FEE INCREASE.  The
 department shall provide written notice to a person who holds an
 unexpired permit or held a permit in the preceding year issued by
 the department under Subchapter E, L, or R at least 90 days before
 the date on which the amount of the fee for that type of permit is
 proposed to increase.  Notice under this section is required only if
 the proposed permit fee amount is at least two times the amount of
 the fee in effect for a permit of that type.
 SECTION 2. Section 43.002, Parks and Wildlife Code, as
 added by this Act, applies only to an increase in the fee for a
 permit as provided by that section that is proposed to take effect
 on or after September 1, 2009. An increase in the fee for a permit
 that is proposed to take effect before September 1, 2009, is
 governed by the law in effect immediately before September 1, 2009,
 and that law continues in effect for that purpose.
 SECTION 3. This Act takes effect September 1, 2009.
