9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 713.008, Health and Safety Code, is | |
11 | 11 | amended to read as follows: | |
12 | 12 | Sec. 713.008. TERMINATION OF MUNICIPAL TRUST BY CERTAIN | |
13 | 13 | MUNICIPALITIES. The governing body of a municipality in a county | |
14 | 14 | with a population of at least 128,000 but not more than 300,000 | |
15 | 15 | [133,000] may abolish the municipality's perpetual trust fund for a | |
16 | 16 | cemetery and use the fund, including both principal and interest, | |
17 | 17 | for permanent improvements to the cemetery. | |
18 | 18 | SECTION 2. This Act takes effect immediately if it receives | |
19 | 19 | a vote of two-thirds of all the members elected to each house, as | |
20 | 20 | provided by Section 39, Article III, Texas Constitution. If this | |
21 | 21 | Act does not receive the vote necessary for immediate effect, this | |
22 | 22 | Act takes effect September 1, 2009. |
