 A BILL TO BE ENTITLED
 AN ACT
 relating to providing public school students subject to in-school
 or out-of-school suspension with relevant class assignments.
 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
 SECTION 1. Section 37.005, Education Code, is amended by
 adding Subsections (d) and (e) to read as follows:
 (d)  Each teacher of a student suspended under this section,
 including a student placed in an in-school suspension setting and a
 student otherwise suspended from school, shall provide the student
 with assignments that are relevant to the lesson plans of the
 classes missed as a result of the suspension.
 (e)  If a student placed into in-school suspension completes
 all assignments before the end of the in-school suspension period,
 the person supervising the student during that period may request
 an additional assignment from the student's teacher.  A teacher
 receiving a request under this subsection shall make a good faith
 effort to provide an additional assignment that is relevant to the
 class lesson plan.
 SECTION 2. This Act applies beginning with the 2009-2010
 school year.
 SECTION 3. This Act takes effect immediately if it receives
 a vote of two-thirds of all the members elected to each house, as
 provided by Section 39, Article III, Texas Constitution. If this
 Act does not receive the vote necessary for immediate effect, this
 Act takes effect September 1, 2009.
