| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter C, Chapter 39, Utilities Code, is |
|---|
| 11 | 11 | | amended by adding Section 39.112 to read as follows: |
|---|
| 12 | 12 | | Sec. 39.112. NOTICE OF PRICE CHANGE. (a) In this section, |
|---|
| 13 | 13 | | "fixed price contract" means a residential retail electric service |
|---|
| 14 | 14 | | contract for which the price for each billing period is stated in |
|---|
| 15 | 15 | | the contract and does not change throughout the term of the |
|---|
| 16 | 16 | | contract. The term does not include month-to-month service. |
|---|
| 17 | 17 | | (b) An electric utility, retail electric provider, electric |
|---|
| 18 | 18 | | cooperative, or municipally owned utility providing residential |
|---|
| 19 | 19 | | service shall provide a residential customer who has a fixed price |
|---|
| 20 | 20 | | contract with written notification of the date the price is |
|---|
| 21 | 21 | | scheduled to change. The notice must be sent to the customer's |
|---|
| 22 | 22 | | billing address by mail postmarked not less than one billing cycle |
|---|
| 23 | 23 | | before the date the price is scheduled to change. |
|---|
| 24 | 24 | | SECTION 2. The change in law made by this Act applies only |
|---|
| 25 | 25 | | to a contract for retail electric service entered into or renewed on |
|---|
| 26 | 26 | | or after the effective date of this Act. A contract for retail |
|---|
| 27 | 27 | | electric service entered into or renewed before the effective date |
|---|
| 28 | 28 | | of this Act is governed by the law as it existed immediately before |
|---|
| 29 | 29 | | the effective date of this Act, and that law is continued in effect |
|---|
| 30 | 30 | | for that purpose. |
|---|
| 31 | 31 | | SECTION 3. This Act takes effect September 1, 2009. |
