55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to an agreement regarding the respective responsibilities
88 of a parent, student, and classroom teacher in certain school
99 districts.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Chapter 26, Education Code, is amended by adding
1212 Section 26.015 to read as follows:
1313 Sec. 26.015. AGREEMENT REGARDING RESPONSIBILITIES OF
1414 PARENT, STUDENT, AND CLASSROOM TEACHER. (a) This section applies
1515 only to a school district that:
1616 (1) has a student enrollment of not more than 35,000;
1717 (2) is located in a county that has a population of at
1818 least 3.4 million; and
1919 (3) borders one or more school districts, each of
2020 which has a student enrollment of at least 40,000.
2121 (b) A school district to which this section applies shall
2222 adopt a written agreement form for each grade level that specifies
2323 the responsibilities of a student's parent as well as the
2424 respective responsibilities of the student and each of the
2525 student's classroom teachers. The parent, the student, and a
2626 school district designee shall sign the appropriate agreement at
2727 the beginning of each school year.
2828 (c) A student in prekindergarten, kindergarten, grade one,
2929 grade two, or grade three is not required to sign the agreement
3030 described by this section.
3131 (d) A school district to which this section applies shall
3232 determine the manner in which the agreement will be enforced,
3333 including any fines or other penalties for an individual's refusal
3434 to sign the agreement or satisfy the individual's responsibilities
3535 under the agreement.
3636 (e) This section expires June 1, 2013.
3737 SECTION 2. This Act applies beginning with the 2009-2010
3838 school year.
3939 SECTION 3. This Act takes effect immediately if it receives
4040 a vote of two-thirds of all the members elected to each house, as
4141 provided by Section 39, Article III, Texas Constitution. If this
4242 Act does not receive the vote necessary for immediate effect, this
4343 Act takes effect September 1, 2009.
