| 8 | 8 | | of a parent, student, and classroom teacher in certain school |
|---|
| 9 | 9 | | districts. |
|---|
| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Chapter 26, Education Code, is amended by adding |
|---|
| 12 | 12 | | Section 26.015 to read as follows: |
|---|
| 13 | 13 | | Sec. 26.015. AGREEMENT REGARDING RESPONSIBILITIES OF |
|---|
| 14 | 14 | | PARENT, STUDENT, AND CLASSROOM TEACHER. (a) This section applies |
|---|
| 15 | 15 | | only to a school district that: |
|---|
| 16 | 16 | | (1) has a student enrollment of not more than 35,000; |
|---|
| 17 | 17 | | (2) is located in a county that has a population of at |
|---|
| 18 | 18 | | least 3.4 million; and |
|---|
| 19 | 19 | | (3) borders one or more school districts, each of |
|---|
| 20 | 20 | | which has a student enrollment of at least 40,000. |
|---|
| 21 | 21 | | (b) A school district to which this section applies shall |
|---|
| 22 | 22 | | adopt a written agreement form for each grade level that specifies |
|---|
| 23 | 23 | | the responsibilities of a student's parent as well as the |
|---|
| 24 | 24 | | respective responsibilities of the student and each of the |
|---|
| 25 | 25 | | student's classroom teachers. The parent, the student, and a |
|---|
| 26 | 26 | | school district designee shall sign the appropriate agreement at |
|---|
| 27 | 27 | | the beginning of each school year. |
|---|
| 28 | 28 | | (c) A student in prekindergarten, kindergarten, grade one, |
|---|
| 29 | 29 | | grade two, or grade three is not required to sign the agreement |
|---|
| 30 | 30 | | described by this section. |
|---|
| 31 | 31 | | (d) A school district to which this section applies shall |
|---|
| 32 | 32 | | determine the manner in which the agreement will be enforced, |
|---|
| 33 | 33 | | including any fines or other penalties for an individual's refusal |
|---|
| 34 | 34 | | to sign the agreement or satisfy the individual's responsibilities |
|---|
| 35 | 35 | | under the agreement. |
|---|
| 36 | 36 | | (e) This section expires June 1, 2013. |
|---|
| 37 | 37 | | SECTION 2. This Act applies beginning with the 2009-2010 |
|---|
| 38 | 38 | | school year. |
|---|
| 39 | 39 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 40 | 40 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 41 | 41 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 42 | 42 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 43 | 43 | | Act takes effect September 1, 2009. |
