66 AN ACT
77 relating to specialty license plates supporting the Safe Routes to
88 School Program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 504.648, Transportation Code, is amended
1111 by amending Subsection (b) and adding Subsections (d) and (e) to
1212 read as follows:
1313 (b) After deduction of the department's administrative
1414 costs, the remainder of the fee [for issuance of the license plates]
1515 shall be deposited to the credit of the share the road account in
1616 the state treasury [state highway fund] and may only be used by the
1717 Texas Education Agency to support [for] the Safe Routes to School
1818 Program of a designated statewide nonprofit organization whose
1919 primary purpose is to promote bicyclist safety, education, and
2020 access through:
2121 (1) education and awareness programs; and
2222 (2) training, workshops, educational materials, and
2323 media events.
2424 (d) Up to 25 percent of the amount in Subsection (b) may be
2525 used to support the activities of the nonprofit organization in
2626 marketing and promoting the Safe Routes to School Program and the
2727 God Bless Texas and God Bless America license plates.
2828 (e) The Texas Education Agency may use money received under
2929 this section to secure funds available under federal matching
3030 programs for safe routes to school and obesity prevention.
3131 SECTION 2. This Act takes effect immediately if it receives
3232 a vote of two-thirds of all the members elected to each house, as
3333 provided by Section 39, Article III, Texas Constitution. If this
3434 Act does not receive the vote necessary for immediate effect, this
3535 Act takes effect September 1, 2009.
