| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Subchapter C, Chapter 39, Utilities Code, is | |
| 11 | 11 | amended by adding Section 39.114 to read as follows: | |
| 12 | 12 | Sec. 39.114. PRICES CHARGED FOR FIXED PRICE CONTRACTS AND | |
| 13 | 13 | MONTH-TO-MONTH SERVICE. (a) In this section, "fixed price | |
| 14 | 14 | contract" means a residential retail electric service contract for | |
| 15 | 15 | which the price is stated in the contract and does not change | |
| 16 | 16 | throughout the term of the contract. The term does not include | |
| 17 | 17 | month-to-month service. | |
| 18 | 18 | (b) A retail electric provider may not offer month-to-month | |
| 19 | 19 | service to a residential customer at a higher price than the price | |
| 20 | 20 | at which the retail electric provider offers a fixed price contract | |
| 21 | 21 | to a new or renewing residential customer. | |
| 22 | 22 | SECTION 2. The change in law made by this Act applies only | |
| 23 | 23 | to a contract for retail electric service entered into or renewed on | |
| 24 | 24 | or after the effective date of this Act. A contract for retail | |
| 25 | 25 | electric service entered into or renewed before the effective date | |
| 26 | 26 | of this Act is governed by the law as it existed immediately before | |
| 27 | 27 | the effective date of this Act, and that law is continued in effect | |
| 28 | 28 | for that purpose. | |
| 29 | 29 | SECTION 3. This Act takes effect September 1, 2009. |
