66 AN ACT
77 relating to requiring insurers to offer conversion of group
88 policies.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 121.256(a) and (b), Insurance Code, are
1111 amended to read as follows:
1212 (a) An insurer shall [may] offer a conversion policy to each
1313 employee, member, or dependent who is covered under a group
1414 accident and health insurance policy that is terminating.
1515 (b) An [If offered, an] issuer shall issue a conversion
1616 policy without evidence of insurability if a written application
1717 for the policy and payment of the first premium are made not later
1818 than the 31st day after the date of termination.
1919 SECTION 2. This Act applies only to an insurance policy or
2020 contract or evidence of coverage that is delivered, issued for
2121 delivery, or renewed on or after January 1, 2010. An insurance
2222 policy or contract or evidence of coverage delivered, issued for
2323 delivery, or renewed before January 1, 2010, is governed by the law
2424 as it existed immediately before the effective date of this Act, and
2525 that law is continued in effect for that purpose.
2626 SECTION 3. This Act takes effect September 1, 2009.
