9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Sections 121.256(a) and (b), Insurance Code, are | |
11 | 11 | amended to read as follows: | |
12 | 12 | (a) An insurer shall [may] offer a conversion policy to each | |
13 | 13 | employee, member, or dependent who is covered under a group | |
14 | 14 | accident and health insurance policy that is terminating. | |
15 | 15 | (b) An [If offered, an] issuer shall issue a conversion | |
16 | 16 | policy without evidence of insurability if a written application | |
17 | 17 | for the policy and payment of the first premium are made not later | |
18 | 18 | than the 31st day after the date of termination. | |
19 | 19 | SECTION 2. This Act applies only to an insurance policy or | |
20 | 20 | contract or evidence of coverage that is delivered, issued for | |
21 | 21 | delivery, or renewed on or after January 1, 2010. An insurance | |
22 | 22 | policy or contract or evidence of coverage delivered, issued for | |
23 | 23 | delivery, or renewed before January 1, 2010, is governed by the law | |
24 | 24 | as it existed immediately before the effective date of this Act, and | |
25 | 25 | that law is continued in effect for that purpose. | |
26 | 26 | SECTION 3. This Act takes effect September 1, 2009. |
