55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the eligibility of certain voters to vote a limited
88 ballot in a new county of residence.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 112.002(a), Election Code, is amended to
1111 read as follows:
1212 (a) After changing residence to another county, a person is
1313 eligible to vote a limited ballot by personal appearance during the
1414 early voting period or by mail if:
1515 (1) the person would have been eligible to vote in the
1616 county of former residence on election day if still residing in that
1717 county;
1818 (2) the person is [was] registered to vote in the
1919 county of former residence at the time the person offers to vote in
2020 the county of new [when the voter changed] residence; and
2121 (3) a voter registration for the person in the county
2222 of new residence is not effective on or before election day.
2323 SECTION 2. This Act takes effect September 1, 2009.
