55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to regulation of the practice of barbering.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 1601.002, Occupations Code, is amended
1010 to read as follows:
1111 Sec. 1601.002. DEFINITION OF BARBERING. In this chapter,
1212 "barbering," "practicing barbering," or the "practice of
1313 barbering" means:
1414 (1) performing or offering or attempting to perform
1515 for compensation or the promise of compensation any of the
1616 following services:
1717 (A) treating a person's mustache or beard by
1818 arranging, beautifying, coloring, processing, shaving, styling, or
1919 trimming;
2020 (B) treating a person's hair by:
2121 (i) arranging, beautifying, bleaching,
2222 cleansing, coloring, curling, dressing, dyeing, processing,
2323 shampooing, shaping, singeing, straightening, styling, tinting, or
2424 waving;
2525 (ii) providing a necessary service that is
2626 preparatory or ancillary to a service under Subparagraph (i),
2727 including bobbing, clipping, cutting, or trimming; or
2828 (iii) cutting the person's hair as a
2929 separate and independent service for which a charge is directly or
3030 indirectly made separately from a charge for any other service;
3131 (C) cleansing, stimulating, or massaging a
3232 person's scalp, face, neck, arms, or shoulders:
3333 (i) by hand or by using a device, apparatus,
3434 or appliance; and
3535 (ii) with or without the use of any cosmetic
3636 preparation, antiseptic, tonic, lotion, or cream;
3737 (D) beautifying a person's face, neck, arms, or
3838 shoulders using a cosmetic preparation, antiseptic, tonic, lotion,
3939 powder, oil, clay, cream, or appliance;
4040 (E) treating a person's nails by:
4141 (i) cutting, trimming, polishing, tinting,
4242 coloring, cleansing, or manicuring [, or pedicuring]; or
4343 (ii) attaching false nails;
4444 (F) massaging, cleansing, treating, or
4545 beautifying a person's hands;
4646 (G) administering facial treatments;
4747 (H) weaving a person's hair by using any method
4848 to attach commercial hair to a person's hair or scalp;
4949 (I) shampooing or conditioning a person's hair;
5050 (J) servicing in any manner listed in Paragraph
5151 (B) a person's wig, toupee, or artificial hairpiece on a person's
5252 head or on a block after the initial retail sale; or
5353 (K) braiding a person's hair, trimming hair
5454 extensions only as applicable to the braiding process, and
5555 attaching commercial hair only by braiding and without the use of
5656 chemicals or adhesives;
5757 (2) advertising or representing to the public in any
5858 manner that a person is a barber or is authorized to practice
5959 barbering; or
6060 (3) advertising or representing to the public in any
6161 manner that a location or place of business is a barbershop,
6262 specialty shop, or barber school.
6363 SECTION 2. Section 1601.051, Occupations Code, is amended
6464 to read as follows:
6565 Sec. 1601.051. BOARD; MEMBERSHIP. The Advisory Board on
6666 Barbering consists of five members appointed by the presiding
6767 officer of the commission, with the commission's approval, as
6868 follows:
6969 (1) two members, each of whom:
7070 (A) is engaged in the practice of barbering as a
7171 Class A barber; and
7272 (B) does not own a barbershop or franchise [hold
7373 a barbershop permit];
7474 (2) two members, each of whom is a barbershop owner who
7575 holds a barbershop permit; and
7676 (3) one member who holds a permit to conduct or operate
7777 a barber school.
7878 SECTION 3. Section 1601.303, Occupations Code, is amended
7979 to read as follows:
8080 Sec. 1601.303. ISSUANCE OF BARBERSHOP PERMIT. The
8181 department shall issue a barbershop permit to an applicant if:
8282 (1) the applicant owns the barbershop;
8383 (2) the applicant verifies the application; [and]
8484 (3) the shop meets the minimum health standards for
8585 barbershops set by the commission and complies with all other
8686 commission rules; and
8787 (4) the shop employs a barber certified under Section
8888 1601.253.
8989 SECTION 4. (a) The change in law made by this Act to the
9090 Advisory Board on Barbering does not affect the entitlement of a
9191 member serving on the board immediately before the effective date
9292 of this Act to serve the remainder of the member's term.
9393 (b) The change in law to Section 1601.303, Occupations Code,
9494 as amended by this Act, applies only to a permit application
9595 submitted on or after the effective date of this Act. An
9696 application submitted before the effective date of this Act is
9797 governed by the law in effect on the date the application was
9898 submitted, and the former law is continued in effect for that
9999 purpose.
100100 SECTION 5. This Act takes effect immediately if it receives
101101 a vote of two-thirds of all the members elected to each house, as
102102 provided by Section 39, Article III, Texas Constitution. If this
103103 Act does not receive the vote necessary for immediate effect, this
104104 Act takes effect September 1, 2009.
