5	5	relating to the creation of the Texas Equine Incentive Program.
6	6	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
7	7	SECTION 1. Chapter 12, Agriculture Code, is amended by
8	8	adding Section 12.044 to read as follows:
9	9	Sec. 12.044. EQUINE INCENTIVE PROGRAM. (a) The department
10	10	shall create and administer an equine incentive program to provide
11	11	an incentive for the owners of certain Texas-based horses to enter
12	12	the horses as participants in horse events in this state. The
13	13	program may apply only to the following breeds of horses:
14	14	(1) Appaloosa horses;
15	15	(2) paint horses; and
16	16	(3) quarter horses.
17	17	(b) On the filing of an annual report with the applicable
18	18	breeders' association, the owner of a stallion that has bred more
19	19	than five mares during the 12-month period preceding the report
20	20	shall submit a duplicate of the report to the department for the
21	21	sixth and any subsequent mare bred by the stallion. An owner
22	22	required to submit a duplicate breeding report by this subsection
23	23	shall pay the department an equine incentive program fee in an
24	24	amount of not less than $30 per mare bred, as determined by the
25	25	department, in connection with each report submitted to the
26	26	department.
27	27	(c) An owner required by Subsection (b) to submit a
28	28	duplicate breeding report and equine incentive program fee may
29	29	elect not to participate in the program by giving written notice to
30	30	the department not later than the 30th day before the owner's annual
31	31	breeding report is due to the applicable breeders' association.
32	32	(d) Notwithstanding Subsection (b), the owner of a stallion
33	33	that has bred fewer than six mares may elect to participate in the
34	34	program by submitting a duplicate breeding report and paying the
35	35	equine incentive program fee required by Subsection (b) for each
36	36	mare bred by the stallion.
37	37	(e) The department by rule shall provide for the use of fees
38	38	collected under Subsection (b) to grant equine incentive awards to
39	39	the owners of eligible foals that participate in horse events in
40	40	this state. A foal is eligible for an incentive award under this
41	41	section only if an equine incentive program fee has been paid on
42	42	behalf of the foal's dam.
43	43	(f) The department by rule shall establish a point system by
44	44	which the owner of an eligible foal may receive an equine incentive
45	45	award based on the foal's participation in horse events held in this
46	46	state that are sanctioned by the applicable horse breeders'
47	47	association.
48	48	(g) The department may use not more than five percent of the
49	49	fees collected under Subsection (b) to administer the program.
50	50	SECTION 2. This Act takes effect September 1, 2009.
