| 10 | 10 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 11 | 11 | SECTION 1. Section 601.053, Transportation Code, is amended | |
| 12 | 12 | by amending Subsection (b) and adding Subsection (c) to read as | |
| 13 | 13 | follows: | |
| 14 | 14 | (b) Except as provided by Subsection (c), an [An] operator | |
| 15 | 15 | who does not exhibit evidence of financial responsibility under | |
| 16 | 16 | Subsection (a) is presumed to have operated the vehicle in | |
| 17 | 17 | violation of Section 601.051. | |
| 18 | 18 | (c) Subsection (b) does not apply if the peace officer | |
| 19 | 19 | determines through use of the verification program established | |
| 20 | 20 | under Subchapter N that financial responsibility has been | |
| 21 | 21 | established for the vehicle. | |
| 22 | 22 | SECTION 2. Subchapter N, Chapter 601, Transportation Code, | |
| 23 | 23 | as added by Chapter 1325 (H.B. 3588), Acts of the 78th Legislature, | |
| 24 | 24 | Regular Session, 2003, is repealed. | |
| 25 | 25 | SECTION 3. This Act takes effect September 1, 2009. |
