55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to authorization for the Department of Aging and
88 Disability Services to conduct a desk review instead of an
99 inspection when issuing a license after a change in ownership of
1010 certain facilities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 142.009, Health and Safety Code, is
1313 amended by amending Subsection (j) and adding Subsection (j-1) to
1414 read as follows:
1515 (j) Except as provided by Subsections (j-1), (h), and (l),
1616 an on-site survey must be conducted within 18 months after a survey
1717 for an initial license. After that time, an on-site survey must be
1818 conducted at least every 36 months.
1919 (j-1) The department, in accordance with department rules,
2020 may conduct a desk review instead of the initial survey required by
2121 Subsection (j) if the license application is submitted due to a
2222 change of ownership of an agency under this chapter. The executive
2323 commissioner of the Health and Human Services Commission by rule
2424 shall develop criteria for determining when the department may
2525 conduct a desk review instead of an on-site survey.
2626 SECTION 2. Section 247.023, Health and Safety Code, is
2727 amended by adding Subsection (a-1) to read as follows:
2828 (a-1) The department, in accordance with department rules,
2929 may conduct a desk review instead of the inspection and
3030 investigation required by Subsection (a) if the license application
3131 is submitted due to a change in ownership of a facility under this
3232 chapter. The executive commissioner of the Health and Human
3333 Services Commission by rule shall develop criteria for determining
3434 when the department may conduct a desk review instead of an
3535 inspection and investigation.
3636 SECTION 3. Section 252.033, Health and Safety Code, is
3737 amended by adding Subsection (a-1) to read as follows:
3838 (a-1) The department, in accordance with department rules,
3939 may conduct a desk review instead of the on-site inspection and
4040 investigation under Subsection (a) if the license application is
4141 submitted due to a change in ownership of a facility under this
4242 chapter. The executive commissioner of the Health and Human
4343 Services Commission by rule shall develop criteria for determining
4444 when the department may conduct a desk review instead of an on-site
4545 inspection and investigation.
4646 SECTION 4. Section 103.006, Human Resources Code, is
4747 amended by adding Subsection (a-1) to read as follows:
4848 (a-1) The department, in accordance with department rules,
4949 may conduct a desk review instead of the on-site inspection under
5050 Subsection (a) if the license application is submitted due to a
5151 change in ownership of the facility under this chapter. The
5252 executive commissioner of the Health and Human Services Commission
5353 by rule shall develop criteria for determining when the department
5454 may conduct a desk review instead of an on-site inspection.
5555 SECTION 5. Not later than March 1, 2010, the executive
5656 commissioner of the Health and Human Services Commission shall
5757 adopt the rules required under Sections 142.009(j-1),
5858 247.023(a-1), and 252.033(a-1), Health and Safety Code, and Section
5959 103.006(a-1), Human Resources Code, as added by this Act.
6060 SECTION 6. This Act takes effect April 1, 2010.
