55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to exemptions from the sales tax for certain
88 energy-efficient products.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 151.333(a) and (b), Tax Code, are
1111 amended to read as follows:
1212 (a) In this section: [,]
1313 (1) "Energy-efficient [energy-efficient] product"
1414 means a product that has been designated as an Energy Star qualified
1515 product under the Energy Star program jointly operated by the
1616 United States Environmental Protection Agency and the United States
1717 Department of Energy.
1818 (2) "Personal computer" means a laptop, desktop, tower
1919 computer system, or other personal computer that contains a central
2020 processing unit, random access memory, and a storage device, and
2121 that may include a display monitor and a keyboard.
2222 (b) This section applies only to the following
2323 energy-efficient products:
2424 (1) an air conditioner the sales price of which does
2525 not exceed $6,000;
2626 (2) a clothes washer;
2727 (3) a ceiling fan;
2828 (4) a dehumidifier;
2929 (5) a dishwasher;
3030 (6) an incandescent or fluorescent lightbulb;
3131 (7) a programmable thermostat; [and]
3232 (8) a refrigerator the sales price of which does not
3333 exceed $2,000; and
3434 (9) a personal computer the sales price of which does
3535 not exceed $1,000.
3636 SECTION 2. The change in law made by this Act does not
3737 affect tax liability accruing before the effective date of this
3838 Act. That liability continues in effect as if this Act had not been
3939 enacted, and the former law is continued in effect for the
4040 collection of taxes due and for civil and criminal enforcement of
4141 the liability for those taxes.
4242 SECTION 3. This Act takes effect September 1, 2009.
