99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 371, Transportation Code, as added by
1111 Chapters 103 (H.B. 570) and 258 (S.B. 11), Acts of the 80th
1212 Legislature, Regular Session, 2007, is reenacted, redesignated as
1313 Chapter 372, Transportation Code, and amended to read as follows:
1414 CHAPTER 372 [371]. PROVISIONS APPLICABLE TO MORE THAN ONE TYPE OF
1515 TOLL PROJECT
1616 SUBCHAPTER A. GENERAL PROVISIONS
1717 Sec. 372.001 [371.001]. DEFINITIONS. In this chapter:
1818 (1) "Toll project" means a toll project described by
1919 Section 201.001(b), regardless of whether the toll project:
2020 (A) is a part of the state highway system; or
2121 (B) is subject to the jurisdiction of the
2222 department.
2323 (2) "Toll project entity" means an entity authorized
2424 by law to acquire, design, construct, finance, operate, and
2525 maintain a toll project, including:
2626 (A) the department under Chapter 227 or 228;
2727 (B) a regional tollway authority under Chapter
2828 366;
2929 (C) a regional mobility authority under Chapter
3030 370; or
3131 (D) a county under Chapter 284.
3232 (3) "Transponder" means a device, placed on or in a
3333 motor vehicle, that is capable of transmitting information used to
3434 assess or to collect tolls.
3535 SUBCHAPTER B. TOLL PROJECT OPERATION
3636 Sec. 372.051 [371.051]. USE OF MOTOR VEHICLE REGISTRATION
3737 OR LICENSE PLATE INFORMATION. (a) A toll project entity may not
3838 use motor vehicle registration or other information derived from a
3939 license plate on a vehicle using a toll project, including
4040 information obtained by the use of automated enforcement technology
4141 described by Section 228.058, for purposes other than those related
4242 to:
4343 (1) toll collection and toll collection enforcement;
4444 and
4545 (2) law enforcement purposes on request by a law
4646 enforcement agency [, subject to Section 228.058(d)].
4747 (b) If a toll project entity enters into an agreement with
4848 an entity in another state that involves the exchange of motor
4949 vehicle registration or license plate information for toll
5050 collection or toll collection enforcement purposes, the agreement
5151 must provide that the information may not be used for purposes other
5252 than those described in Subsection (a).
5353 Sec. 372.052 [371.001]. VEHICLES USED BY NONPROFIT DISASTER
5454 RELIEF ORGANIZATIONS. [(a) In this section:
5555 [(1) "Toll project" means a toll project described by
5656 Section 201.001(b), regardless of whether the toll project is:
5757 [(A) a part of the state highway system; or
5858 [(B) subject to the jurisdiction of the
5959 department.
6060 [(2) "Toll project entity" means an entity authorized
6161 by law to acquire, design, construct, finance, operate, and
6262 maintain a toll project, including:
6363 [(A) the department under Chapter 227 or 228;
6464 [(B) a regional tollway authority under Chapter
6565 366;
6666 [(C) a regional mobility authority under Chapter
6767 370; or
6868 [(D) a county under Chapter 284.
6969 [(b)] A toll project entity may not require a vehicle
7070 registered under Section 502.203 to pay a toll for the use of a toll
7171 project.
7272 Sec. 372.053. Uniform Signage Plan. The Commission as
7373 defined by Chapter 201.001, shall adopt a plan creating uniform
7474 standards for toll roads signs which includes provisions for
7575 standard spacing, information, and design of the signs.
7676 SECTION 2. This Act takes effect September 1, 2009.
