66 AN ACT
77 relating to the exclusion of certain college savings plan assets
88 and benefits from eligibility determination for certain public
99 assistance programs.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter C, Chapter 62, Health and Safety
1212 Code, is amended by adding Section 62.1012 to read as follows:
1313 Sec. 62.1012. EXCLUSION OF COLLEGE SAVINGS PLANS. For
1414 purposes of determining whether a child meets family income and
1515 resource requirements for eligibility for the child health plan,
1616 the commission may not consider as income or resources a right to
1717 assets held in or a right to receive payments or benefits under any
1818 of the following:
1919 (1) any fund or plan established under Subchapter F or
2020 H, Chapter 54, Education Code, including an interest in a prepaid
2121 tuition contract;
2222 (2) any fund or plan established under Subchapter G,
2323 Chapter 54, Education Code, including an interest in a savings
2424 trust account; or
2525 (3) any qualified tuition program of any state that
2626 meets the requirements of Section 529, Internal Revenue Code of
2727 1986.
2828 SECTION 2. Subchapter A, Chapter 31, Human Resources Code,
2929 is amended by adding Section 31.0039 to read as follows:
3030 Sec. 31.0039. EXCLUSION OF COLLEGE SAVINGS PLANS. For
3131 purposes of determining the amount of financial assistance granted
3232 to an individual under this chapter for the support of dependent
3333 children or determining whether the family meets household income
3434 and resource requirements for financial assistance under this
3535 chapter, the department may not consider the right to assets held in
3636 or the right to receive payments or benefits under any of the
3737 following:
3838 (1) any fund or plan established under Subchapter F or
3939 H, Chapter 54, Education Code, including an interest in a prepaid
4040 tuition contract;
4141 (2) any fund or plan established under Subchapter G,
4242 Chapter 54, Education Code, including an interest in a savings
4343 trust account; or
4444 (3) any qualified tuition program of any state that
4545 meets the requirements of Section 529, Internal Revenue Code of
4646 1986.
4747 SECTION 3. Subchapter B, Chapter 32, Human Resources Code,
4848 is amended by adding Section 32.02611 to read as follows:
4949 Sec. 32.02611. EXCLUSION OF COLLEGE SAVINGS PLANS. (a)
5050 Except as provided by Subsection (b), in determining eligibility
5151 and need for medical assistance, the department may not consider as
5252 assets or resources a right to assets held in or a right to receive
5353 payments or benefits under any of the following:
5454 (1) any fund or plan established under Subchapter F or
5555 H, Chapter 54, Education Code, including an interest in a prepaid
5656 tuition contract;
5757 (2) any fund or plan established under Subchapter G,
5858 Chapter 54, Education Code, including an interest in a savings
5959 trust account; or
6060 (3) any qualified tuition program of any state that
6161 meets the requirements of Section 529, Internal Revenue Code of
6262 1986.
6363 (b) In determining eligibility and need for medical
6464 assistance for an applicant who may be eligible on the basis of the
6565 applicant's eligibility for medical assistance for the aged, blind,
6666 or disabled under 42 U.S.C. Section 1396a(10), as amended, the
6767 department may consider as assets or resources a right to assets
6868 held in or a right to receive payments or benefits under any fund,
6969 plan, or tuition program described by Subsection (a).
7070 (c) Notwithstanding Subsection (b), the department shall
7171 seek a federal waiver authorizing the department to exclude, for
7272 purposes of determining the eligibility of an applicant described
7373 by that subsection, the right to assets held in or a right to
7474 receive payments or benefits under any fund, plan, or tuition
7575 program described by Subsection (a) if the fund, plan, or tuition
7676 program was established before the 21st birthday of the beneficiary
7777 of the fund, plan, or tuition program.
7878 SECTION 4. If before implementing any provision of this Act
7979 a state agency determines that a waiver or authorization from a
8080 federal agency is necessary for implementation of that provision,
8181 the agency affected by the provision shall request the waiver or
8282 authorization and may delay implementing that provision until the
8383 waiver or authorization is granted.
8484 SECTION 5. The changes in law made by this Act apply to a
8585 person who receives health benefits coverage under Chapter 62,
8686 Health and Safety Code, financial assistance under Chapter 31,
8787 Human Resources Code, or medical assistance under Chapter 32, Human
8888 Resources Code, on or after the effective date of this Act,
8989 regardless of the date on which eligibility for coverage or
9090 assistance was initially determined.
9191 SECTION 6. This Act takes effect September 1, 2009.
