55 relating to the election and terms of office of directors of the
66 Guadalupe County Groundwater Conservation District.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 9, Chapter 1066, Acts of the 75th
99 Legislature, Regular Session, 1997, is amended to read as follows:
1010 Sec. 9. ELECTION OF DIRECTORS. [(a)] On the uniform
1111 election date in November of each odd-numbered year, the district
1212 shall hold an election in the district to elect [first Saturday in
1313 May of the second year after the year in which the district is
1414 authorized to be created at a confirmation election, an election
1515 shall be held in the district for the election of three directors,
1616 each of whom shall serve a two-year term, and four directors, each
1717 of whom shall serve a four-year term.
1818 [(b) On the first Saturday in May of each subsequent second
1919 year following the election,] the appropriate number of directors
2020 [shall be elected] to the district's board of directors.
2121 SECTION 2. Section 6(g), Chapter 1066, Acts of the 75th
2222 Legislature, Regular Session, 1997, is repealed.
2323 SECTION 3. (a) All governmental acts and proceedings of the
2424 Guadalupe County Groundwater Conservation District relating to the
2525 election of members of the board of directors of the district that
2626 were taken before the effective date of this Act are validated,
2727 ratified, and confirmed in all respects as if they had been taken as
2828 authorized by law.
2929 (b) This section does not apply to any matter that on the
3030 effective date of this Act:
3131 (1) is involved in litigation if the litigation
3232 ultimately results in the matter being held invalid by a final court
3333 judgment; or
3434 (2) has been held invalid by a final court judgment.
3535 SECTION 4. (a) The legal notice of the intention to
3636 introduce this Act, setting forth the general substance of this
3737 Act, has been published as provided by law, and the notice and a
3838 copy of this Act have been furnished to all persons, agencies,
3939 officials, or entities to which they are required to be furnished
4040 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
4141 Government Code.
4242 (b) The governor, one of the required recipients, has
4343 submitted the notice and Act to the Texas Commission on
4444 Environmental Quality.
4545 (c) The Texas Commission on Environmental Quality has filed
4646 its recommendations relating to this Act with the governor, the
4747 lieutenant governor, and the speaker of the house of
4848 representatives within the required time.
4949 (d) All requirements of the constitution and laws of this
5050 state and the rules and procedures of the legislature with respect
5151 to the notice, introduction, and passage of this Act are fulfilled
5252 and accomplished.
5353 SECTION 5. This Act takes effect immediately if it receives
5454 a vote of two-thirds of all the members elected to each house, as
5555 provided by Section 39, Article III, Texas Constitution. If this
5656 Act does not receive the vote necessary for immediate effect, this
5757 Act takes effect September 1, 2009.
