55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to pretrial hearings in criminal cases.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Article 28.01, Code of Criminal Procedure, is
1010 amended by adding Section 4 to read as follows:
1111 Sec. 4. A court shall set a pre-trial hearing in any
1212 criminal case if the state or the defendant requests the hearing.
1313 The court must hold the hearing not later than the 30th day before
1414 the date on which trial commences.
1515 SECTION 2. This Act applies only to a criminal case in which
1616 the indictment or information is presented to the court on or after
1717 the effective date of this Act. A criminal case in which the
1818 indictment or information is presented to the court before the
1919 effective date of this Act is governed by the law in effect when the
2020 indictment or information is presented, and the former law is
2121 continued in effect for that purpose.
2222 SECTION 3. This Act takes effect September 1, 2009.
