| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Subchapter B, Chapter 202, Transportation Code, |
|---|
| 12 | 12 | | is amended by adding Section 202.0215 to read as follows: |
|---|
| 13 | 13 | | Sec. 202.0215. OFFER OF CERTAIN REAL PROPERTY TO NONPROFIT |
|---|
| 14 | 14 | | CORPORATION. (a) In this section, "nonprofit corporation" means a |
|---|
| 15 | 15 | | corporation governed as a nonprofit corporation under the Texas |
|---|
| 16 | 16 | | Non-Profit Corporation Act (Article 1396-1.01 et seq., Vernon's |
|---|
| 17 | 17 | | Texas Civil Statutes) or under Chapter 22, Business Organizations |
|---|
| 18 | 18 | | Code. |
|---|
| 19 | 19 | | (b) The department as part of the acquisition of real |
|---|
| 20 | 20 | | property for right-of-way purposes may take title to unusable |
|---|
| 21 | 21 | | remainder real property not to be used for right-of-way purposes. |
|---|
| 22 | 22 | | (c) Notwithstanding Section 202.021, the department shall |
|---|
| 23 | 23 | | offer the real property described by Subsection (b) to a nonprofit |
|---|
| 24 | 24 | | corporation designated by the municipality in which the real |
|---|
| 25 | 25 | | property is located or, if the real property is not located in a |
|---|
| 26 | 26 | | municipality, by the county in which the real property is located, |
|---|
| 27 | 27 | | without cost or expense to the designated nonprofit corporation. |
|---|
| 28 | 28 | | (d) Property acquired under this section by a nonprofit |
|---|
| 29 | 29 | | corporation or by another entity from a nonprofit corporation that |
|---|
| 30 | 30 | | acquired the property under this section must be used for the public |
|---|
| 31 | 31 | | purpose of development and diversification of the state economy. |
|---|
| 32 | 32 | | SECTION 2. This Act takes effect September 1, 2009. |
