| 9 | 9 | | relating to a municipal consent agreement regarding the inclusion |

| 10 | 10 | | of land in the extraterritorial jurisdiction of a municipality on |

| 11 | 11 | | the creation or expansion of certain municipal utility districts. |

| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. (a) Section 54.016(f), Water Code, is repealed. |
|---|
| 14 | 14 | | (b) Section 54.016(h), Water Code, is repealed. |
|---|
| 15 | 15 | | SECTION 2. The legislature finds that an agreement between |
|---|
| 16 | 16 | | a municipality and a municipal utility district is an allocation |
|---|
| 17 | 17 | | agreement only if the agreement strictly complies with the |
|---|
| 18 | 18 | | requirements of Section 54.016(f), Water Code, and is specifically |
|---|
| 19 | 19 | | designated by the parties to the agreement as an "allocation |
|---|
| 20 | 20 | | agreement." |

| 21 | 21 | | SECTION 3. The changes in law made by this Act do not apply |
|---|
| 22 | 22 | | to an agreement that is the subject of a lawsuit filed by a |
|---|
| 23 | 23 | | political subdivision before the effective date of this Act. A |
|---|
| 24 | 24 | | lawsuit filed before the effective date of this Act is governed by |
|---|
| 25 | 25 | | the law in effect on the date the lawsuit was filed, and the former |
|---|
| 26 | 26 | | law is continued in effect for that purpose. |
|---|
| 27 | 27 | | SECTION 4. (a) Section 1(a) of this Act takes effect January |
|---|
| 28 | 28 | | 1, 2010. |
|---|
| 29 | 29 | | (b) Except as provided by Subsection (a) of this section, |
|---|
| 30 | 30 | | this Act takes effect immediately if it receives a vote of |
|---|
| 31 | 31 | | two-thirds of all the members elected to each house, as provided by |
|---|
| 32 | 32 | | Section 39, Article III, Texas Constitution. If this Act does not |
|---|
| 33 | 33 | | receive the vote necessary for immediate effect, this Act takes |
|---|
| 34 | 34 | | effect September 1, 2009. |
