| 11 | 11 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 12 | 12 | | SECTION 1. Section 508.141, Government Code, is amended by |
|---|
| 13 | 13 | | amending Subsection (d) and adding Subsection (d-1) to read as |
|---|
| 14 | 14 | | follows: |
|---|
| 15 | 15 | | (d) A parole panel may release an inmate on parole during |
|---|
| 16 | 16 | | the parole month established for the inmate, or at an earlier time |
|---|
| 17 | 17 | | in accordance with Subsection (d-1), if the panel determines that |
|---|
| 18 | 18 | | the inmate's release will not increase the likelihood of harm to the |
|---|
| 19 | 19 | | public. |
|---|
| 20 | 20 | | (d-1) If a parole panel requires, as a condition of release, |
|---|
| 21 | 21 | | that an inmate complete a specific department rehabilitation |
|---|
| 22 | 22 | | program before release, the department shall place the inmate in |
|---|
| 23 | 23 | | the program specified by the parole panel, except that the |
|---|
| 24 | 24 | | department may place the inmate in a different program with the |
|---|
| 25 | 25 | | approval of the parole panel. If the inmate successfully completes |
|---|
| 26 | 26 | | a department rehabilitation program specified or approved by the |
|---|
| 27 | 27 | | parole panel under this subsection and satisfies all other |
|---|
| 28 | 28 | | conditions of release specified by the parole panel before the |
|---|
| 29 | 29 | | parole month established for the inmate, the department shall |
|---|
| 30 | 30 | | promptly notify the parole panel for purposes of considering the |
|---|
| 31 | 31 | | inmate's immediate release. |
|---|
| 32 | 32 | | SECTION 2. The change in law made by this Act applies to any |
|---|
| 33 | 33 | | inmate who is confined in a facility operated by or under contract |
|---|
| 34 | 34 | | with the Texas Department of Criminal Justice on or after the |
|---|
| 35 | 35 | | effective date of this Act, regardless of when the inmate's period |
|---|
| 36 | 36 | | of confinement began. |

| 37 | 37 | | SECTION 3. This Act takes effect September 1, 2009. |
