99 AN ACT
1010 relating to the operation of certain institutions of higher
1111 education as general academic teaching institutions and to the
1212 statutory limitation imposed on certain university systems to issue
1313 revenue bonds to fund facilities at certain institutions of higher
1414 education.
1515 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1616 SECTION 1. Section 87.841(d), Education Code, is amended to
1717 read as follows:
1818 (d) Notwithstanding any other provision of this subchapter,
1919 Texas A&M University--San Antonio may not operate as a general
2020 academic teaching institution until the Texas Higher Education
2121 Coordinating Board certifies that enrollment at the Texas A&M
2222 University--Kingsville System Center--San Antonio has reached an
2323 enrollment equivalent of[:
2424 [(1)] 1,000 full-time students for one semester [if
2525 the legislature authorizes revenue bonds to be issued to finance
2626 educational and related facilities for the institution, and the
2727 bonds are issued for that purpose; or
2828 [(2) 2,500 full-time students for one semester if the
2929 conditions specified by Subdivision (1) are not satisfied].
3030 SECTION 2. Section 105.501(d), Education Code, is amended
3131 to read as follows:
3232 (d) Notwithstanding any other provision of this subchapter,
3333 the University of North Texas at Dallas may operate as a general
3434 academic teaching institution with its own chief executive officer,
3535 administration, and faculty only after the Texas Higher Education
3636 Coordinating Board certifies that enrollment at the University of
3737 North Texas System Center at Dallas has reached an enrollment
3838 equivalent to 1,000 full-time students for one semester. Until
3939 that enrollment level is reached, the board may operate a system
4040 center of the University of North Texas in the city of Dallas.
4141 [Prior to reaching 2,500 full-time equivalent students, the
4242 University of North Texas at Dallas may not receive general revenue
4343 in excess of the 2003 expended amount with the exception of funding
4444 provided through the General Academic Instruction and Operations
4545 Formula for semester credit hour increases and the Tuition Revenue
4646 Bond debt service for bonds approved in the 78th Legislature. The
4747 institution will not be eligible to receive the small school
4848 supplement in the General Academic Instruction and Operations
4949 Formula until it reaches 2,500 full-time equivalent student
5050 enrollment.]
5151 SECTION 3. The following statutes are repealed:
5252 (1) Sections 55.1751(d) and (e), Education Code; and
5353 (2) Section 55.1755(d), Education Code.
5454 SECTION 4. This Act takes effect immediately if it receives
5555 a vote of two-thirds of all the members elected to each house, as
5656 provided by Section 39, Article III, Texas Constitution. If this
5757 Act does not receive the vote necessary for immediate effect, this
5858 Act takes effect September 1, 2009.
