9	9	AN ACT
10	10	relating to the operation of certain institutions of higher
11	11	education as general academic teaching institutions and to the
12	12	statutory limitation imposed on certain university systems to issue
13	13	revenue bonds to fund facilities at certain institutions of higher
14	14	education.
15	15	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
16	16	SECTION 1. Section 87.841(d), Education Code, is amended to
17	17	read as follows:
18	18	(d) Notwithstanding any other provision of this subchapter,
19	19	Texas A&M University--San Antonio may not operate as a general
20	20	academic teaching institution until the Texas Higher Education
21	21	Coordinating Board certifies that enrollment at the Texas A&M
22	22	University--Kingsville System Center--San Antonio has reached an
23	23	enrollment equivalent of[:
24	24	[(1)] 1,000 full-time students for one semester [if
25	25	the legislature authorizes revenue bonds to be issued to finance
26	26	educational and related facilities for the institution, and the
27	27	bonds are issued for that purpose; or
28	28	[(2) 2,500 full-time students for one semester if the
29	29	conditions specified by Subdivision (1) are not satisfied].
30	30	SECTION 2. Section 105.501(d), Education Code, is amended
31	31	to read as follows:
32	32	(d) Notwithstanding any other provision of this subchapter,
33	33	the University of North Texas at Dallas may operate as a general
34	34	academic teaching institution with its own chief executive officer,
35	35	administration, and faculty only after the Texas Higher Education
36	36	Coordinating Board certifies that enrollment at the University of
37	37	North Texas System Center at Dallas has reached an enrollment
38	38	equivalent to 1,000 full-time students for one semester. Until
39	39	that enrollment level is reached, the board may operate a system
40	40	center of the University of North Texas in the city of Dallas.
41	41	[Prior to reaching 2,500 full-time equivalent students, the
42	42	University of North Texas at Dallas may not receive general revenue
43	43	in excess of the 2003 expended amount with the exception of funding
44	44	provided through the General Academic Instruction and Operations
45	45	Formula for semester credit hour increases and the Tuition Revenue
46	46	Bond debt service for bonds approved in the 78th Legislature. The
47	47	institution will not be eligible to receive the small school
48	48	supplement in the General Academic Instruction and Operations
49	49	Formula until it reaches 2,500 full-time equivalent student
50	50	enrollment.]
51	51	SECTION 3. The following statutes are repealed:
52	52	(1) Sections 55.1751(d) and (e), Education Code; and
53	53	(2) Section 55.1755(d), Education Code.
54	54	SECTION 4. This Act takes effect immediately if it receives
55	55	a vote of two-thirds of all the members elected to each house, as
56	56	provided by Section 39, Article III, Texas Constitution. If this
57	57	Act does not receive the vote necessary for immediate effect, this
58	58	Act takes effect September 1, 2009.
