66 AN ACT
77 relating to the use of solar energy in certain state buildings,
88 public school facilities, and higher education facilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter I, Chapter 2166, Government Code, is
1111 amended by adding Section 2166.409 to read as follows:
1212 Sec. 2166.409. USE OF SOLAR ENERGY IN STATE BUILDINGS. (a)
1313 In this section, "solar energy device" means a system or series of
1414 mechanisms designed primarily to provide heating or cooling or to
1515 produce electrical or mechanical power by collecting and
1616 transferring solar-generated energy. The term includes a
1717 mechanical or chemical device that has the ability to store
1818 solar-generated energy for use in heating or cooling or in the
1919 production of power.
2020 (b) This section applies to the construction of a new state
2121 building and the acquisition of a building by the state, including a
2222 building construction project otherwise exempt from this chapter
2323 under Section 2166.003.
2424 (c) During the planning phase of the proposed construction,
2525 the commission, or the governing body of the appropriate agency or
2626 institution that is undertaking a project otherwise exempt from
2727 this chapter under Section 2166.003, shall include in the
2828 construction plans for a new state building the use of a solar
2929 energy device.
3030 (d) Not later than one year after the acquisition by the
3131 state of a building that does not use a solar energy device, the
3232 state agency or institution of higher education that has charge and
3333 control of the acquired building shall retrofit the building with a
3434 solar energy device.
3535 SECTION 2. Subchapter Z, Chapter 44, Education Code, is
3636 amended by adding Section 44.906 to read as follows:
3737 Sec. 44.906. USE OF SOLAR ENERGY IN INSTRUCTIONAL
3838 FACILITIES. (a) In this section:
3939 (1) "Instructional facility" has the meaning assigned
4040 by Section 46.001.
4141 (2) "Solar energy device" means a system or series of
4242 mechanisms designed primarily to provide heating or cooling or to
4343 produce electrical or mechanical power by collecting and
4444 transferring solar-generated energy. The term includes a
4545 mechanical or chemical device that has the ability to store
4646 solar-generated energy for use in heating or cooling or in the
4747 production of power.
4848 (b) A school district that constructs a new instructional
4949 facility shall include in the construction plans for the facility
5050 the use of a solar energy device.
5151 (c) Not later than one year after the acquisition by a
5252 school district of a building to be used as an instructional
5353 facility that does not use a solar energy device, the school
5454 district shall retrofit the acquired building with a solar energy
5555 device.
5656 SECTION 3. Subchapter Z, Chapter 51, Education Code, is
5757 amended by adding Section 51.9273 to read as follows:
5858 Sec. 51.9273. USE OF SOLAR ENERGY IN EDUCATIONAL AND
5959 HOUSING FACILITIES. (a) In this section:
6060 (1) "Housing facility" has the meaning assigned by
6161 Section 53.02.
6262 (2) "Solar energy device" means a system or series of
6363 mechanisms designed primarily to provide heating or cooling or to
6464 produce electrical or mechanical power by collecting and
6565 transferring solar-generated energy. The term includes a
6666 mechanical or chemical device that has the ability to store
6767 solar-generated energy for use in heating or cooling or in the
6868 production of power.
6969 (b) An institution of higher education that constructs a new
7070 educational or housing facility shall include in the construction
7171 plans for the facility the use of a solar energy device.
7272 (c) Not later than one year after the acquisition by an
7373 institution of higher education of a building to be used as an
7474 educational or housing facility that does not use a solar energy
7575 device, the institution of higher education shall retrofit the
7676 acquired building with a solar energy device.
7777 SECTION 4. This Act takes effect September 1, 2009.
