77 relating to the statute of limitations in a civil suit for sexual
88 assault.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Section 16.0045, Civil Practice
1111 and Remedies Code, is amended to read as follows:
1212 Sec. 16.0045. 10-YEAR [FIVE-YEAR] LIMITATIONS PERIOD.
1313 SECTION 2. Section 16.0045(a), Civil Practice and Remedies
1414 Code, is amended to read as follows:
1515 (a) A person must bring suit for personal injury not later
1616 than 10 [five] years after the day the cause of action accrues if
1717 the injury arises as a result of conduct that violates:
1818 (1) Section 22.011, Penal Code (sexual assault);
1919 (2) Section 22.021, Penal Code (aggravated sexual
2020 assault); or
2121 (3) Section 21.02, Penal Code (continuous sexual abuse
2222 of young child or children).
2323 SECTION 3. The change in law made by this Act applies only
2424 to a cause of action that accrues on or after the effective date of
2525 this Act. A cause of action that accrues before the effective date
2626 of this Act is governed by the law in effect immediately before the
2727 effective date of this Act, and that law is continued in effect for
2828 that purpose.
2929 SECTION 4. This Act takes effect September 1, 2009.
