9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. The heading to Section 16.0045, Civil Practice | |
11 | 11 | and Remedies Code, is amended to read as follows: | |
12 | 12 | Sec. 16.0045. 10-YEAR [FIVE-YEAR] LIMITATIONS PERIOD. | |
13 | 13 | SECTION 2. Section 16.0045(a), Civil Practice and Remedies | |
14 | 14 | Code, is amended to read as follows: | |
15 | 15 | (a) A person must bring suit for personal injury not later | |
16 | 16 | than 10 [five] years after the day the cause of action accrues if | |
17 | 17 | the injury arises as a result of conduct that violates: | |
18 | 18 | (1) Section 22.011, Penal Code (sexual assault); | |
19 | 19 | (2) Section 22.021, Penal Code (aggravated sexual | |
20 | 20 | assault); or | |
21 | 21 | (3) Section 21.02, Penal Code (continuous sexual abuse | |
22 | 22 | of young child or children). | |
23 | 23 | SECTION 3. The change in law made by this Act applies only | |
24 | 24 | to a cause of action that accrues on or after the effective date of | |
25 | 25 | this Act. A cause of action that accrues before the effective date | |
26 | 26 | of this Act is governed by the law in effect immediately before the | |
27 | 27 | effective date of this Act, and that law is continued in effect for | |
28 | 28 | that purpose. | |
29 | 29 | SECTION 4. This Act takes effect September 1, 2009. |
