5	5	relating to temporary housing and emergency shelters provided by a
6	6	political subdivision for disaster victims.
7	7	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
8	8	SECTION 1. Section 418.004, Government Code, is amended by
9	9	adding Subdivision (6-a) to read as follows:
10	10	(6-a) "Public facility" has the meaning assigned by
11	11	Section 102, Robert T. Stafford Disaster Relief and Emergency
12	12	Assistance Act (42 U.S.C. Section 5122).
13	13	SECTION 2. Section 418.020, Government Code, is amended to
14	14	read as follows:
15	15	Sec. 418.020. TEMPORARY HOUSING AND EMERGENCY SHELTER. (a)
16	16	The governor may enter into purchase, lease, or other arrangements
17	17	with an agency of the United States for temporary housing units to
18	18	be occupied by disaster victims and may make units available to any
19	19	political subdivision.
20	20	(b) The governor may assist a political subdivision that is
21	21	the locus of temporary housing or emergency shelters for disaster
22	22	victims to acquire sites necessary for temporary housing or
23	23	emergency shelters and to do all things required to prepare the
24	24	sites to receive and use temporary housing units or emergency
25	25	shelters by:
26	26	(1) advancing or lending funds available to the
27	27	governor from any appropriation made by the legislature or from any
28	28	other source;
29	29	(2) allocating funds made available by a public or
30	30	private agency; or
31	31	(3) becoming a copartner with the political
32	32	subdivision for the execution and performance of any temporary
33	33	housing or emergency shelter project for disaster victims.
34	34	(c) Under regulations prescribed by the governor, the
35	35	governor may temporarily suspend or modify for a period of not more
36	36	than 60 days any public health, safety, zoning, intrastate
37	37	transportation, or other law or regulation if by proclamation the
38	38	governor considers the suspension or modification essential to
39	39	provide temporary housing or emergency shelter for disaster
40	40	victims.
41	41	(d) Any political subdivision may temporarily or
42	42	permanently acquire by lease, purchase, or other means sites
43	43	required for installation of temporary housing units or emergency
44	44	shelters for disaster victims and may enter into arrangements
45	45	necessary to prepare or equip the sites to use the housing units or
46	46	shelters, including arrangements for the purchase of temporary
47	47	housing units or shelters and the payment of transportation
48	48	charges.
49	49	(e) A political subdivision that is the locus of temporary
50	50	housing or emergency shelters for persons moved or evacuated by
51	51	recommendation or order of the governor may be assisted by any
52	52	resource available to the state, including the disaster contingency
53	53	fund, to ensure the political subdivision receives an advance or
54	54	reimbursement:
55	55	(1) of all expenses, including lost revenue, incurred
56	56	by the political subdivision associated with the use of public
57	57	facilities for temporary housing or emergency shelters; and
58	58	(2) of the amounts paid for salaries and benefits of
59	59	permanently employed, straight-time and regular-time personnel of
60	60	the political subdivision who perform duties associated with the
61	61	movement or evacuation of persons into, out of, or through the
62	62	political subdivision.
63	63	SECTION 3. This Act takes effect September 1, 2009.
