77 relating to credit card marketing activities at postsecondary
88 educational institutions.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter L, Chapter 35, Business & Commerce
1111 Code, as added by Chapter 130 (H.B. 85), Acts of the 80th
1212 Legislature, Regular Session, 2007, is amended by adding Section
1313 35.1315 to read as follows:
1414 Sec. 35.1315. APPLICABILITY OF SUBCHAPTER. (a) This
1515 subchapter does not apply to credit card marketing activities
1616 conducted by credit card issuers at events held on the campus of a
1717 postsecondary educational institution that are not primarily for
1818 students or are not exclusively student-related activities, and
1919 that either are open to the general public or are conducted for
2020 persons who are not required to be students, such as athletics
2121 events, concerts, other special events, or alumni meetings.
2222 (b) This section does not prohibit the governing board of a
2323 postsecondary educational institution from establishing
2424 restrictions on campus credit card marketing activities within the
2525 scope of the general authority of the governing board.
2626 SECTION 2. Subchapter L, Chapter 35, Business & Commerce
2727 Code, as added by Chapter 130 (H.B. 85), Acts of the 80th
2828 Legislature, Regular Session, 2007, is amended by adding Section
2929 35.1325 to read as follows:
3030 Sec. 35.1325. PROHIBITION AGAINST DISCLOSURE OF STUDENT
3131 CONTACT INFORMATION FOR PURPOSES OF CREDIT CARD SOLICITATION. A
3232 postsecondary educational institution may not disclose to a credit
3333 card issuer contact information regarding any student of the
3434 institution. For purposes of this section, a student's contact
3535 information includes the student's name, telephone number, e-mail
3636 address, permanent or campus residence address, and mailing
3737 address. If the institution is subject to Chapter 552, Government
3838 Code, the institution is not required to seek a decision from the
3939 attorney general under that chapter in order to withhold student
4040 contact information from a credit card issuer that makes a written
4141 request for the information.
4242 SECTION 3. Section 35.135, Business & Commerce Code, as
4343 added by Chapter 130 (H.B. 85), Acts of the 80th Legislature,
4444 Regular Session, 2007, is amended to read as follows:
4545 Sec. 35.135. RESTRICTION ON GIFTS OR INCENTIVES FOR
4646 COMPLETING CREDIT CARD APPLICATION. A credit card issuer may not
4747 offer a gift or other incentive in exchange for the completion of a
4848 credit card application as part of a campus credit card marketing
4949 activity [unless the credit card issuer, at the time the credit card
5050 issuer provides a credit card application to an individual,
5151 provides financial educational material developed under Section
5252 35.133 to the individual].
5353 SECTION 4. Subchapter A, Chapter 761, Business & Commerce
5454 Code, as effective September 1, 2009, is amended by adding Section
5555 761.0015 to read as follows:
5656 Sec. 761.0015. APPLICABILITY OF CHAPTER. (a) This chapter
5757 does not apply to credit card marketing activities conducted by
5858 credit card issuers at events held on the campus of a postsecondary
5959 educational institution that are not primarily for students or are
6060 not exclusively student-related activities, and that either are
6161 open to the general public or are conducted for persons who are not
6262 required to be students, such as athletics events, concerts, other
6363 special events, or alumni meetings.
6464 (b) This section does not prohibit the governing board of a
6565 postsecondary educational institution from establishing
6666 restrictions on campus credit card marketing activities within the
6767 scope of the general authority of the governing board.
6868 SECTION 5. Subchapter B, Chapter 761, Business & Commerce
6969 Code, as effective September 1, 2009, is amended by adding Section
7070 761.0515 to read as follows:
7171 Sec. 761.0515. PROHIBITION AGAINST DISCLOSURE OF STUDENT
7272 CONTACT INFORMATION FOR PURPOSES OF CREDIT CARD SOLICITATION. A
7373 postsecondary educational institution may not disclose to a credit
7474 card issuer contact information regarding any student of the

8383 SECTION 6. Section 761.052, Business & Commerce Code, as
8484 effective September 1, 2009, is amended to read as follows:
8585 Sec. 761.052. RESTRICTION ON GIFTS OR INCENTIVES FOR
8686 COMPLETING CREDIT CARD APPLICATION. A credit card issuer may not
8787 offer a gift or other incentive in exchange for the completion of a
8888 credit card application as part of a campus credit card marketing
8989 activity [unless the credit card issuer, at the time the credit card
9090 issuer provides a credit card application to an individual,
9191 provides financial educational material developed under Section
9292 761.101 to the individual].
9393 SECTION 7. (a) Sections 1, 2, and 3 of this Act take effect
9494 only if the Act of the 81st Legislature, Regular Session, 2009,
9595 relating to nonsubstantive additions to and corrections in existing
9696 codes does not become law.
9797 (b) Sections 4, 5, and 6 of this Act take effect only if the
9898 Act of the 81st Legislature, Regular Session, 2009, relating to
9999 nonsubstantive additions to and corrections in existing codes
100100 becomes law.
101101 SECTION 8. This Act takes effect September 1, 2009.
