| 9 | 9 | | responsibility. |

| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 601.076, Transportation Code, is amended |
|---|
| 12 | 12 | | to read as follows: |
|---|
| 13 | 13 | | Sec. 601.076. REQUIRED TERMS: OWNER'S POLICY. (a) An |
|---|
| 14 | 14 | | owner's motor vehicle liability insurance policy must: |
|---|
| 15 | 15 | | (1) cover each motor vehicle for which coverage is to |
|---|
| 16 | 16 | | be granted under the policy; and |
|---|
| 17 | 17 | | (2) pay, on behalf of the named insured or another |
|---|
| 18 | 18 | | person who, as insured, uses a covered motor vehicle with the |
|---|
| 19 | 19 | | express or implied permission of the named insured, amounts the |
|---|
| 20 | 20 | | insured becomes obligated to pay as damages arising out of the |
|---|
| 21 | 21 | | ownership, maintenance, or use of the motor vehicle in the United |
|---|
| 22 | 22 | | States or Canada, subject to the amounts, excluding interest and |
|---|
| 23 | 23 | | costs, and exclusions of Section 601.072. |
|---|
| 24 | 24 | | (b) This section does not prohibit the named insured from |
|---|
| 25 | 25 | | excluding specific persons from coverage under the policy. An |
|---|
| 26 | 26 | | exclusion under this section must be in writing and must: |
|---|
| 27 | 27 | | (1) include the name of the person excluded from |
|---|
| 28 | 28 | | coverage; |
|---|
| 29 | 29 | | (2) be signed by the named insured; and |
|---|
| 30 | 30 | | (3) be attached to the policy. |
|---|
| 31 | 31 | | SECTION 2. This Act applies only to a motor vehicle |
|---|
| 32 | 32 | | insurance policy delivered, issued for delivery, or renewed on or |
|---|
| 33 | 33 | | after January 1, 2010. A policy delivered, issued for delivery, or |
|---|
| 34 | 34 | | renewed before January 1, 2010, is governed by the law as it existed |
|---|
| 35 | 35 | | immediately before the effective date of this Act, and that law is |
|---|
| 36 | 36 | | continued in effect for that purpose. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect September 1, 2009. |
