77 relating to the inclusion of a student representative on a
88 district-level planning and decision-making committee.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 11.251(b) and (e), Education Code, are
1111 amended to read as follows:
1212 (b) The board shall adopt a policy to establish a district-
1313 and campus-level planning and decision-making process that will
1414 involve the professional staff of the district, parents, students,
1515 and community members in establishing and reviewing the district's
1616 and campuses' educational plans, goals, performance objectives,
1717 and major classroom instructional programs. The board shall
1818 establish a procedure under which meetings are held regularly by
1919 district- and campus-level planning and decision-making committees
2020 that include representative professional staff, parents of
2121 students enrolled in the district, business representatives, and
2222 community members. The board of trustees of a school district that
2323 includes at least one high school campus shall establish a
2424 procedure under which a student representative is included as a
2525 member of the district-level committee. The committees shall
2626 include a business representative without regard to whether the
2727 representative resides in the district or whether the business the
2828 person represents is located in the district. The board, or the
2929 board's designee, shall periodically meet with the district-level
3030 committee to review the district-level committee's deliberations.
3131 (e) The board shall adopt a procedure, consistent with
3232 Section 21.407(a), for the professional staff in the district to
3333 nominate and elect the professional staff representatives who shall
3434 meet with the board or the board designee as required under this
3535 section. At least two-thirds of the elected professional staff
3636 representatives must be classroom teachers. The remaining staff
3737 representatives shall include both campus- and district-level
3838 professional staff members. Board policy must provide procedures
3939 for:
4040 (1) the selection of parents to the district-level and
4141 campus-level committees; [and]
4242 (2) the selection of community members and business
4343 representatives to serve on the district-level committee in a
4444 manner that provides for appropriate representation of the
4545 community's diversity; and
4646 (3) the selection of a student representative to the
4747 district-level committee.
4848 SECTION 2. This Act applies beginning with the 2009-2010
4949 school year.
5050 SECTION 3. This Act takes effect immediately if it receives
5151 a vote of two-thirds of all the members elected to each house, as
5252 provided by Section 39, Article III, Texas Constitution. If this
5353 Act does not receive the vote necessary for immediate effect, this
5454 Act takes effect September 1, 2009.
