| 7 | 7 | | relating to the inclusion of a student representative on a |
|---|
| 8 | 8 | | district-level planning and decision-making committee. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|---|
| 10 | 10 | | SECTION 1. Sections 11.251(b) and (e), Education Code, are |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (b) The board shall adopt a policy to establish a district- |
|---|
| 13 | 13 | | and campus-level planning and decision-making process that will |
|---|
| 14 | 14 | | involve the professional staff of the district, parents, students, |
|---|
| 15 | 15 | | and community members in establishing and reviewing the district's |
|---|
| 16 | 16 | | and campuses' educational plans, goals, performance objectives, |
|---|
| 17 | 17 | | and major classroom instructional programs. The board shall |
|---|
| 18 | 18 | | establish a procedure under which meetings are held regularly by |
|---|
| 19 | 19 | | district- and campus-level planning and decision-making committees |
|---|
| 20 | 20 | | that include representative professional staff, parents of |
|---|
| 21 | 21 | | students enrolled in the district, business representatives, and |
|---|
| 22 | 22 | | community members. The board of trustees of a school district that |
|---|
| 23 | 23 | | includes at least one high school campus shall establish a |
|---|
| 24 | 24 | | procedure under which a student representative is included as a |
|---|
| 25 | 25 | | member of the district-level committee. The committees shall |
|---|
| 26 | 26 | | include a business representative without regard to whether the |
|---|
| 27 | 27 | | representative resides in the district or whether the business the |
|---|
| 28 | 28 | | person represents is located in the district. The board, or the |
|---|
| 29 | 29 | | board's designee, shall periodically meet with the district-level |
|---|
| 30 | 30 | | committee to review the district-level committee's deliberations. |
|---|
| 31 | 31 | | (e) The board shall adopt a procedure, consistent with |
|---|
| 32 | 32 | | Section 21.407(a), for the professional staff in the district to |
|---|
| 33 | 33 | | nominate and elect the professional staff representatives who shall |
|---|
| 34 | 34 | | meet with the board or the board designee as required under this |
|---|
| 35 | 35 | | section. At least two-thirds of the elected professional staff |
|---|
| 36 | 36 | | representatives must be classroom teachers. The remaining staff |
|---|
| 37 | 37 | | representatives shall include both campus- and district-level |
|---|
| 38 | 38 | | professional staff members. Board policy must provide procedures |
|---|
| 39 | 39 | | for: |
|---|
| 40 | 40 | | (1) the selection of parents to the district-level and |
|---|
| 41 | 41 | | campus-level committees; [and] |
|---|
| 42 | 42 | | (2) the selection of community members and business |
|---|
| 43 | 43 | | representatives to serve on the district-level committee in a |
|---|
| 44 | 44 | | manner that provides for appropriate representation of the |
|---|
| 45 | 45 | | community's diversity; and |
|---|
| 46 | 46 | | (3) the selection of a student representative to the |
|---|
| 47 | 47 | | district-level committee. |
|---|
| 48 | 48 | | SECTION 2. This Act applies beginning with the 2009-2010 |
|---|
| 49 | 49 | | school year. |
|---|
| 50 | 50 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 51 | 51 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 52 | 52 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 53 | 53 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 54 | 54 | | Act takes effect September 1, 2009. |
