6	6	AN ACT
7	7	relating to design, construction, and renovation standards for
8	8	state buildings and facilities.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Subchapter I, Chapter 2166, Government Code, is
11	11	amended by adding Section 2166.409 to read as follows:
12	12	Sec. 2166.409. HIGH-PERFORMANCE, SUSTAINABLE DESIGN,
13	13	CONSTRUCTION, AND RENOVATION STANDARDS FOR STATE BUILDINGS.
14	14	(a) This section applies to the construction of a state building,
15	15	or the renovation of a state building the cost of which is more than
16	16	50 percent of the value of the building, including a building for
17	17	education, assembly, or office occupancy under the charge and
18	18	control of the Texas Department of Transportation, the Parks and
19	19	Wildlife Department, the Texas Department of Housing and Community
20	20	Affairs, the Texas State Affordable Housing Corporation, or the
21	21	Veterans' Land Board that is otherwise exempt from this chapter
22	22	under Section 2166.003.
23	23	(b) A building to which this section applies must be
24	24	designed and constructed or renovated so that the building achieves
25	25	certification under a high-performance building standard that:
26	26	(1) is developed and revised through a consensus-based
27	27	process;
28	28	(2) provides minimum requirements for energy use,
29	29	natural resources use, and indoor air quality;
30	30	(3) requires substantiating documentation for
31	31	certification;
32	32	(4) employs third-party, post-construction review and
33	33	verification for certification; and
34	34	(5) is determined by the state energy conservation
35	35	office to be nationally recognized in the building industry.
36	36	(c) A contract between the commission and a private design
37	37	professional relating to services in connection with the
38	38	construction or renovation of a building to which this section
39	39	applies must provide that, for billing purposes, any service
40	40	provided by the private design professional that is necessary to
41	41	satisfy the requirements of Subsection (b) is considered an
42	42	additional service rather than a basic service.
43	43	SECTION 2. Subchapter B, Chapter 55, Education Code, is
44	44	amended by adding Section 55.115 to read as follows:
45	45	Sec. 55.115. HIGH-PERFORMANCE, SUSTAINABLE DESIGN,
46	46	CONSTRUCTION, AND RENOVATION STANDARDS FOR CERTAIN FACILITIES.
47	47	(a) This section applies to the construction of an institution of
48	48	higher education building, structure, or other facility, or the
49	49	renovation of a building, structure, or other facility the cost of
50	50	which is more than 50 percent of the value of the building,
51	51	structure, or other facility, any part of the construction or
52	52	renovation of which is financed by revenue bonds issued under this
53	53	subchapter.
54	54	(b) A building, structure, or other facility to which this
55	55	section applies must be designed and constructed or renovated so
56	56	that the building, structure, or other facility achieves
57	57	certification under a high-performance building standard that:
58	58	(1) is developed and revised through a consensus-based
59	59	process;
60	60	(2) provides minimum requirements for energy use,
61	61	natural resources use, and indoor air quality;
62	62	(3) requires substantiating documentation for
63	63	certification;
64	64	(4) employs third-party, post-construction review and
65	65	verification for certification; and
66	66	(5) is determined by the state energy conservation
67	67	office to be nationally recognized in the building industry.
68	68	(c) A contract between an institution of higher education
69	69	and a private design professional, as defined by Section 2166.001,
70	70	Government Code, relating to services in connection with the
71	71	construction or renovation of a building, structure, or other
72	72	facility to which this section applies must provide that, for
73	73	billing purposes, any service provided by the private design
74	74	professional that is necessary to satisfy the requirements of
75	75	Subsection (b) is considered an additional service rather than a
76	76	basic service.
77	77	SECTION 3. Section 55.115, Education Code, and Section
78	78	2166.409, Government Code, as added by this Act, apply only to an
79	79	institution of higher education building, structure, or other
80	80	facility or a state building for which the contract for design
81	81	services is entered into on or after September 1, 2011.
82	82	SECTION 4. This Act takes effect September 1, 2009.
