55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to design, construction, and renovation standards for
88 state buildings and facilities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter I, Chapter 2166, Government Code, is
1111 amended by adding Section 2166.409 to read as follows:
1212 Sec. 2166.409. HIGH-PERFORMANCE, SUSTAINABLE DESIGN,
1313 CONSTRUCTION, AND RENOVATION STANDARDS FOR STATE BUILDINGS.
1414 (a) This section applies to the construction of a state building,
1515 or the renovation of a state building the cost of which is more than
1616 50 percent of the value of the building, including a building for
1717 education, assembly, or office occupancy under the charge and
1818 control of the Texas Department of Transportation, the Parks and
1919 Wildlife Department, the Texas Department of Housing and Community
2020 Affairs, the Texas State Affordable Housing Corporation, or the
2121 Veterans' Land Board that is otherwise exempt from this chapter
2222 under Section 2166.003.
2323 (b) A building to which this section applies must be
2424 designed and constructed or renovated so that the building achieves
2525 certification under a high-performance building standard that:
2626 (1) is developed and revised through a consensus-based
2727 process;
2828 (2) provides minimum requirements for energy use,
2929 natural resources use, and indoor air quality;
3030 (3) requires substantiating documentation for
3131 certification;
3232 (4) employs third-party, post-construction review and
3333 verification for certification; and
3434 (5) is determined by the state energy conservation
3535 office to be nationally recognized in the building industry.
3636 (c) A contract between the commission and a private design
3737 professional relating to services in connection with the
3838 construction or renovation of a building to which this section
3939 applies must provide that, for billing purposes, any service
4040 provided by the private design professional that is necessary to
4141 satisfy the requirements of Subsection (b) is considered an
4242 additional service rather than a basic service.
4343 SECTION 2. Subchapter B, Chapter 55, Education Code, is
4444 amended by adding Section 55.115 to read as follows:
4545 Sec. 55.115. HIGH-PERFORMANCE, SUSTAINABLE DESIGN,
4646 CONSTRUCTION, AND RENOVATION STANDARDS FOR CERTAIN FACILITIES.
4747 (a) This section applies to the construction of an institution of
4848 higher education building, structure, or other facility, or the
4949 renovation of a building, structure, or other facility the cost of
5050 which is more than 50 percent of the value of the building,
5151 structure, or other facility, any part of the construction or
5252 renovation of which is financed by revenue bonds issued under this
5353 subchapter.
5454 (b) A building, structure, or other facility to which this
5555 section applies must be designed and constructed or renovated so
5656 that the building, structure, or other facility achieves
5757 certification under a high-performance building standard that:
5858 (1) is developed and revised through a consensus-based
5959 process;
6060 (2) provides minimum requirements for energy use,
6161 natural resources use, and indoor air quality;
6262 (3) requires substantiating documentation for
6363 certification;
6464 (4) employs third-party, post-construction review and
6565 verification for certification; and
6666 (5) is determined by the state energy conservation
6767 office to be nationally recognized in the building industry.
6868 (c) A contract between an institution of higher education
6969 and a private design professional, as defined by Section 2166.001,
7070 Government Code, relating to services in connection with the
7171 construction or renovation of a building, structure, or other
7272 facility to which this section applies must provide that, for
7373 billing purposes, any service provided by the private design
7474 professional that is necessary to satisfy the requirements of
7575 Subsection (b) is considered an additional service rather than a
7676 basic service.
7777 SECTION 3. Section 55.115, Education Code, and Section
7878 2166.409, Government Code, as added by this Act, apply only to an
7979 institution of higher education building, structure, or other
8080 facility or a state building for which the contract for design
8181 services is entered into on or after September 1, 2011.
8282 SECTION 4. This Act takes effect September 1, 2009.
