99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle A, Title 5, Special District Local Laws
1111 Code, is amended by adding Chapter 5006 to read as follows:
1212 CHAPTER 5006. MATAGORDA COUNTY NAVIGATION DISTRICT NO. 1
1313 SUBCHAPTER A. GENERAL PROVISIONS
1414 Sec. 5006.001. DEFINITIONS. In this chapter:
1515 (1) "Board" means the board of navigation and canal
1616 commissioners of the district.
1717 (2) "Commissioner" means a member of the board.
1818 (3) "District" means the Matagorda County Navigation
1919 District No. 1.

2121 SUBCHAPTER B. DISTRICT ADMINISTRATION
2222 Sec. 5006.051. BOARD OF COMMISSIONERS; TERM; ELECTION. (a)
2323 The district is governed by a board consisting of five
2424 commissioners elected at large.
2525 (b) Commissioners serve staggered six-year terms, with the
2626 terms of one or two commissioners expiring on November 30 of each
2727 even-numbered year.
2828 (c) An election shall be held in the district every two
2929 years on the uniform election date in November to elect one or two
3030 commissioners.
3131 SECTION 2. (a) Notwithstanding Section 5006.051, Special
3232 District Local Laws Code, as added by this Act, on the uniform
3333 election date in November 2010, the board of navigation and canal
3434 commissioners of the Matagorda County Navigation District No. 1
3535 shall hold an election to elect:
3636 (1) one commissioner to serve a term expiring
3737 November 30, 2014; and
3838 (2) two commissioners to serve terms expiring
3939 November 30, 2016.
4040 (b) On the uniform election date in November of each
4141 even-numbered year after 2010, the board of navigation and canal
4242 commissioners of the Matagorda County Navigation District No. 1
4343 shall hold an election to elect the appropriate number of
4444 commissioners to serve six-year terms.
4545 SECTION 3. This Act takes effect immediately if it receives
4646 a vote of two-thirds of all the members elected to each house, as
4747 provided by Section 39, Article III, Texas Constitution. If this
4848 Act does not receive the vote necessary for immediate effect, this
4949 Act takes effect September 1, 2009.
