99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1111 Code, is amended by adding Chapter 8305 to read as follows:
1212 CHAPTER 8305. SEDONA LAKES MUNICIPAL UTILITY DISTRICT NO. 1 OF
1313 BRAZORIA COUNTY
1414 SUBCHAPTER A. GENERAL PROVISIONS
1515 Sec. 8305.001. DEFINITION. In this chapter, "district"
1616 means the Sedona Lakes Municipal Utility District No. 1 of Brazoria
1717 County.

1919 SUBCHAPTER B. POWERS AND DUTIES
2020 Sec. 8305.051. MUNICIPAL UTILITY DISTRICT POWERS AND
2121 DUTIES. The district has the powers and duties provided by the
2222 general law of this state, including Chapters 49 and 54, Water Code,
2323 applicable to municipal utility districts created under Section 59,
2424 Article XVI, Texas Constitution.
2525 Sec. 8305.052. AUTHORITY FOR ROAD PROJECTS. Under Section
2626 52, Article III, Texas Constitution, the district may design,
2727 acquire, construct, finance, issue bonds for, improve, operate,
2828 maintain, and convey to this state, a county, or a municipality for
2929 operation and maintenance macadamized, graveled, or paved roads, or
3030 improvements, including storm drainage, in aid of those roads.
3131 Sec. 8305.053. ROAD STANDARDS AND REQUIREMENTS. (a) A road
3232 project must meet all applicable construction standards, zoning and
3333 subdivision requirements, and regulations of each municipality in
3434 whose corporate limits or extraterritorial jurisdiction the road
3535 project is located.
3636 (b) If a road project is not located in the corporate limits
3737 or extraterritorial jurisdiction of a municipality, the road
3838 project must meet all applicable construction standards,
3939 subdivision requirements, and regulations of each county in which
4040 the road project is located.
4141 (c) If the state will maintain and operate the road, the
4242 Texas Transportation Commission must approve the plans and
4343 specifications of the road project.
4444 Sec. 8305.054. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
4545 OR RESOLUTION. The district shall comply with all applicable
4646 requirements of any ordinance or resolution that is adopted under
4747 Section 54.016 or 54.0165, Water Code, including any ordinance or
4848 resolution adopted before September 1, 2009, and that consents to
4949 the creation of the district or to the inclusion of land in the
5050 district.
5151 Sec. 8305.055. LIMITATION ON USE OF EMINENT DOMAIN. The
5252 district may not exercise the power of eminent domain outside the
5353 district to acquire a site or easement for:
5454 (1) a road project authorized by Section 8305.052; or
5555 (2) a recreational facility as defined by Section
5656 49.462, Water Code.

5959 Sec. 8305.101. TAX TO REPAY BONDS. The district may impose
6060 a tax to pay the principal of or interest on bonds or other
6161 obligations issued under Section 8305.151.

6363 SUBCHAPTER D. BONDS AND OTHER OBLIGATIONS
6464 Sec. 8305.151. AUTHORITY TO ISSUE BONDS AND OTHER
6565 OBLIGATIONS. The district may issue bonds or other obligations
6666 payable wholly or partly from ad valorem taxes, impact fees,
6767 revenue, contract payments, grants, or other district money, or any
6868 combination of those sources, to pay for any authorized district
6969 purpose.
7070 Sec. 8305.152. TAXES FOR BONDS. At the time the district
7171 issues bonds payable wholly or partly from ad valorem taxes, the
7272 board shall provide for the annual imposition of a continuing
7373 direct ad valorem tax, without limit as to rate or amount, while all
7474 or part of the bonds are outstanding as required and in the manner
7575 provided by Sections 54.601 and 54.602, Water Code.
7676 Sec. 8305.153. BONDS FOR ROAD PROJECTS. (a) The district
7777 may not issue bonds payable from ad valorem taxes to finance a road
7878 project unless the issuance is approved by a vote of a two-thirds
7979 majority of the district voters voting at an election held for that
8080 purpose.
8181 (b) At the time of issuance, the total principal amount of
8282 bonds or other obligations issued or incurred to finance road
8383 projects and payable from ad valorem taxes may not exceed
8484 one-fourth of the assessed value of the real property in the
8585 district.
8686 SECTION 2. (a) The legal notice of the intention to
8787 introduce this Act, setting forth the general substance of this
8888 Act, has been published as provided by law, and the notice and a
8989 copy of this Act have been furnished to all persons, agencies,
9090 officials, or entities to which they are required to be furnished
9191 under Section 59, Article XVI, Texas Constitution, and Chapter 313,
9292 Government Code.
9393 (b) The governor, one of the required recipients, has
9494 submitted the notice and Act to the Texas Commission on
9595 Environmental Quality.
9696 (c) The Texas Commission on Environmental Quality has filed
9797 its recommendations relating to this Act with the governor, the
9898 lieutenant governor, and the speaker of the house of
9999 representatives within the required time.
100100 (d) All requirements of the constitution and laws of this
101101 state and the rules and procedures of the legislature with respect
102102 to the notice, introduction, and passage of this Act are fulfilled
103103 and accomplished.
104104 SECTION 3. This Act takes effect immediately if it receives
105105 a vote of two-thirds of all the members elected to each house, as
106106 provided by Section 39, Article III, Texas Constitution. If this
107107 Act does not receive the vote necessary for immediate effect, this
108108 Act takes effect September 1, 2009.
