99 relating to an intercollegiate athletics fee at the University of
1010 North Texas.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter E, Chapter 54, Education Code, is
1313 amended by adding Section 54.5191 to read as follows:
1414 Sec. 54.5191. INTERCOLLEGIATE ATHLETICS FEE; UNIVERSITY OF
1515 NORTH TEXAS. (a) The board of regents of the University of North
1616 Texas System may charge each student enrolled at the University of
1717 North Texas an intercollegiate athletics fee in an amount not to
1818 exceed $10 per semester credit hour for each semester or summer
1919 session.
2020 (b) A student enrolled in more than 15 semester credit hours
2121 shall pay the fee in an amount equal to the amount imposed on a
2222 student enrolled in 15 semester credit hours during the same
2323 semester or session.
2424 (c) The fee may not be charged before the first semester a
2525 new football stadium is available for use at the university.
2626 (d) If compulsory student services fees are charged to
2727 students enrolled at the university under Section 54.503, the total
2828 amount of those fees charged to a student shall be reduced by $3 per
2929 semester credit hour for the first semester in which an
3030 intercollegiate athletics fee is charged under this section.
3131 (e) Revenue from the fee charged under this section may be
3232 used only for financing, constructing, operating, maintaining, or
3333 improving an athletic facility or for operating an intercollegiate
3434 athletics program at the university.
3535 (f) The fee may not be charged unless approved by a majority
3636 vote of the students enrolled at the university who participate in a
3737 general student election held for that purpose. The ballot for the
3838 election to approve the fee must state a maximum amount of the fee
3939 that may be charged per semester credit hour, not to exceed the
4040 maximum amount prescribed by Subsection (a).
4141 (g) The amount of the fee may not be increased to an amount
4242 that exceeds by 10 percent or more the amount of the fee as last
4343 approved by a student vote under Subsection (f) or this subsection
4444 unless the increase has been approved by a majority vote of the
4545 students enrolled at the university who participate in a general
4646 student election held for that purpose.
4747 (h) The chief fiscal officer of the university shall collect
4848 the fee and shall deposit the revenue from the fee in an account to
4949 be known as the intercollegiate athletics fee account.
5050 (i) A fee charged under this section is not considered in
5151 determining the maximum amount of student services fees that may be
5252 charged each student enrolled at the university under Section
5353 54.503.
5454 (j) The fee may not be charged after the fifth academic year
5555 in which the fee is first charged unless, before the end of that
5656 academic year, the university has issued bonds payable in whole or
5757 in part from the fee, in which event the fee may not be charged after
5858 the academic year in which all such bonds, including refunding
5959 bonds for those bonds, have been fully paid.
6060 SECTION 2. This Act takes effect immediately if it receives
6161 a vote of two-thirds of all the members elected to each house, as
6262 provided by Section 39, Article III, Texas Constitution. If this
6363 Act does not receive the vote necessary for immediate effect, this
6464 Act takes effect September 1, 2009.
