8	8	AN ACT
9	9	relating to an intercollegiate athletics fee at the University of
10	10	North Texas.
11	11	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
12	12	SECTION 1. Subchapter E, Chapter 54, Education Code, is
13	13	amended by adding Section 54.5191 to read as follows:
14	14	Sec. 54.5191. INTERCOLLEGIATE ATHLETICS FEE; UNIVERSITY OF
15	15	NORTH TEXAS. (a) The board of regents of the University of North
16	16	Texas System may charge each student enrolled at the University of
17	17	North Texas an intercollegiate athletics fee in an amount not to
18	18	exceed $10 per semester credit hour for each semester or summer
19	19	session.
20	20	(b) A student enrolled in more than 15 semester credit hours
21	21	shall pay the fee in an amount equal to the amount imposed on a
22	22	student enrolled in 15 semester credit hours during the same
23	23	semester or session.
24	24	(c) The fee may not be charged before the first semester a
25	25	new football stadium is available for use at the university.
26	26	(d) If compulsory student services fees are charged to
27	27	students enrolled at the university under Section 54.503, the total
28	28	amount of those fees charged to a student shall be reduced by $3 per
29	29	semester credit hour for the first semester in which an
30	30	intercollegiate athletics fee is charged under this section.
31	31	(e) Revenue from the fee charged under this section may be
32	32	used only for financing, constructing, operating, maintaining, or
33	33	improving an athletic facility or for operating an intercollegiate
34	34	athletics program at the university.
35	35	(f) The fee may not be charged unless approved by a majority
36	36	vote of the students enrolled at the university who participate in a
37	37	general student election held for that purpose. The ballot for the
38	38	election to approve the fee must state a maximum amount of the fee
39	39	that may be charged per semester credit hour, not to exceed the
40	40	maximum amount prescribed by Subsection (a).
41	41	(g) The amount of the fee may not be increased to an amount
42	42	that exceeds by 10 percent or more the amount of the fee as last
43	43	approved by a student vote under Subsection (f) or this subsection
44	44	unless the increase has been approved by a majority vote of the
45	45	students enrolled at the university who participate in a general
46	46	student election held for that purpose.
47	47	(h) The chief fiscal officer of the university shall collect
48	48	the fee and shall deposit the revenue from the fee in an account to
49	49	be known as the intercollegiate athletics fee account.
50	50	(i) A fee charged under this section is not considered in
51	51	determining the maximum amount of student services fees that may be
52	52	charged each student enrolled at the university under Section
53	53	54.503.
54	54	(j) The fee may not be charged after the fifth academic year
55	55	in which the fee is first charged unless, before the end of that
56	56	academic year, the university has issued bonds payable in whole or
57	57	in part from the fee, in which event the fee may not be charged after
58	58	the academic year in which all such bonds, including refunding
59	59	bonds for those bonds, have been fully paid.
60	60	SECTION 2. This Act takes effect immediately if it receives
61	61	a vote of two-thirds of all the members elected to each house, as
62	62	provided by Section 39, Article III, Texas Constitution. If this
63	63	Act does not receive the vote necessary for immediate effect, this
64	64	Act takes effect September 1, 2009.
