99 relating to delegation by a physician of certain cosmetic and
1010 dermatological medical treatments.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter A, Chapter 157, Occupations Code, is
1313 amended by adding Section 157.008 to read as follows:
1414 Sec. 157.008. DELEGATION OF COSMETIC AND DERMATOLOGICAL
1515 MEDICAL TREATMENTS. (a) In accordance with rules adopted by the
1616 board, a physician may delegate to a qualified and properly trained
1717 physician assistant, advanced practice nurse, or other properly
1818 trained individual:
1919 (1) the administration of botulinum toxin injections;
2020 (2) administration of dermal fillers; or
2121 (3) cosmetic or aesthetic medical treatments.
2222 (b) The administration of a medical treatment described
2323 under Subsection (a) must be in compliance with laws relating to the
2424 practice of medicine and state and federal laws relating to the
2525 administration of a medical treatment.
2626 SECTION 2. Not later than January 1, 2010, the Texas Medical
2727 Board shall adopt rules necessary to implement Section 157.008,
2828 Occupations Code, as added by this Act.
2929 SECTION 3. This Act takes effect September 1, 2009.
