66 AN ACT
77 relating to notice to certain public school high school seniors and
88 their parents or guardians of automatic college admission.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 28.026, Education Code, is amended to
1111 read as follows:
1212 Sec. 28.026. NOTICE OF AUTOMATIC COLLEGE ADMISSION. (a)
1313 The board of trustees of a school district shall require each high
1414 school in the district to post appropriate signs in each
1515 counselor's office, in each principal's office, and in each
1616 administrative building indicating the substance of Section 51.803
1717 regarding automatic college admission. To assist in the
1818 dissemination of this information, the school district shall:
1919 (1) require that each high school counselor and class
2020 advisor be provided a detailed explanation of the substance of
2121 Section 51.803;
2222 (2) require that each high school counselor and senior
2323 class advisor explain to eligible students the substance of Section
2424 51.803; and
2525 (3) not later than the 14th day after the last day of
2626 classes for the fall semester or an equivalent date in the case of a
2727 school operated on a year-round system under Section 25.084,
2828 provide each eligible senior student under Section 51.803 and the
2929 student's parent or guardian[, at the commencement of a class's
3030 senior year,] with a written notification of the student's
3131 eligibility with a detailed explanation in plain language of the
3232 substance of Section 51.803.
3333 (b) The agency shall adopt a form to use in providing notice
3434 under Subsection (a)(3). The notice to a student and the student's
3535 parent or guardian must be on a single form. The form may contain
3636 one or more signature lines to indicate receipt of notice by the
3737 student or the student's parent or guardian. In providing notice
3838 under Subsection (a)(3), a school district shall use the form
3939 adopted by the agency.
4040 SECTION 2. (a) The Texas Education Agency shall adopt a form
4141 for notifying eligible high school seniors and their parents or
4242 guardians of automatic college admission as required by Section
4343 28.026, Education Code, as amended by this Act, as soon as
4444 practicable after the effective date of this Act.
4545 (b) A school district shall provide notice to eligible high
4646 school seniors and their parents or guardians of automatic college
4747 admission as required by Section 28.026, Education Code, as amended
4848 by this Act, beginning with the 2009-2010 school year.
4949 SECTION 3. This Act takes effect immediately if it receives
5050 a vote of two-thirds of all the members elected to each house, as
5151 provided by Section 39, Article III, Texas Constitution. If this
5252 Act does not receive the vote necessary for immediate effect, this
5353 Act takes effect September 1, 2009.
