55 relating to the creation of the Hood County Granbury Municipal
66 Utility District No. 1; providing authority to impose a tax and
77 issue bonds; granting a limited power of eminent domain.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Subtitle F, Title 6, Special District Local Laws
1010 Code, is amended by adding Chapter 8342 to read as follows:
1111 CHAPTER 8342. HOOD COUNTY GRANBURY MUNICIPAL UTILITY
1212 DISTRICT NO. 1
1313 SUBCHAPTER A. GENERAL PROVISIONS
1414 Sec. 8342.001. DEFINITIONS. In this chapter:
1515 (1) "Board" means the district's board of directors.
1616 (2) "Director" means a board member.
1717 (3) "District" means the Hood County Granbury
1818 Municipal Utility District No. 1.
1919 Sec. 8342.002. NATURE OF DISTRICT. The district is a
2020 municipal utility district created under Section 59, Article XVI,
2121 Texas Constitution.
2222 Sec. 8342.003. CONFIRMATION AND DIRECTORS' ELECTION
2323 REQUIRED. The temporary directors shall hold an election to
2424 confirm the creation of the district and to elect five permanent
2525 directors as provided by Section 49.102, Water Code.
2626 Sec. 8342.004. CONSENT OF MUNICIPALITY AND DEVELOPMENT
2727 AGREEMENT REQUIRED. (a) The temporary directors may not hold an
2828 election under Section 8342.003 until each municipality in whose
2929 corporate limits or extraterritorial jurisdiction the district is
3030 located has:
3131 (1) consented by ordinance or resolution to the
3232 creation of the district; and
3333 (2) entered into a development agreement with the
3434 majority owner of the assessed value of the real property in the
3535 district.
3636 (b) If a development agreement required under Subsection
3737 (a)(2) has not been entered into before September 1, 2010:
3838 (1) the district is dissolved September 1, 2010,
3939 except that:
4040 (A) any debts incurred shall be paid;
4141 (B) any assets that remain after the payment of
4242 debts shall be transferred to Hood County; and
4343 (C) the organization of the district shall be
4444 maintained until all debts are paid and remaining assets are
4545 transferred; and
4646 (2) this chapter expires September 1, 2013.
4747 Sec. 8342.005. FINDINGS OF PUBLIC PURPOSE AND BENEFIT. (a)
4848 The district is created to serve a public purpose and benefit.
4949 (b) The district is created to accomplish the purposes of:
5050 (1) a municipal utility district as provided by
5151 general law and Section 59, Article XVI, Texas Constitution; and
5252 (2) Section 52, Article III, Texas Constitution, that
5353 relate to the construction, acquisition, improvement, operation,
5454 or maintenance of macadamized, graveled, or paved roads, or
5555 improvements, including storm drainage, in aid of those roads.
5656 Sec. 8342.006. INITIAL DISTRICT TERRITORY. (a) The
5757 district is initially composed of the territory described by
5858 Section 2 of the Act creating this chapter.
5959 (b) The boundaries and field notes contained in Section 2 of
6060 the Act creating this chapter form a closure. A mistake made in the
6161 field notes or in copying the field notes in the legislative process
6262 does not affect the district's:
6363 (1) organization, existence, or validity;
6464 (2) right to issue any type of bond for the purposes
6565 for which the district is created or to pay the principal of and
6666 interest on a bond;
6767 (3) right to impose a tax; or
6868 (4) legality or operation.

7070 SUBCHAPTER B. BOARD OF DIRECTORS
7171 Sec. 8342.051. GOVERNING BODY; TERMS. (a) The district is
7272 governed by a board of five elected directors.
7373 (b) Except as provided by Section 8342.052, directors serve
7474 staggered four-year terms.
7575 Sec. 8342.052. TEMPORARY DIRECTORS. (a) The temporary
7676 board consists of:
7777 (1) Jeffrey Krueger;
7878 (2) William Bruce Schneider;
7979 (3) Kevin Patton;
8080 (4) Virgil R. Briscoe; and
8181 (5) Jeffrey K. Wilson.
8282 (b) Temporary directors serve until the earlier of:
8383 (1) the date permanent directors are elected under
8484 Section 8342.003; or
8585 (2) September 1, 2013.
8686 (c) If permanent directors have not been elected under
8787 Section 8342.003 and the terms of the temporary directors have
8888 expired, successor temporary directors shall be appointed or
8989 reappointed as provided by Subsection (d) to serve terms that
9090 expire on the earlier of:
9191 (1) the date permanent directors are elected under
9292 Section 8342.003; or
9393 (2) the fourth anniversary of the date of the
9494 appointment or reappointment.
9595 (d) If Subsection (c) applies, the owner or owners of a
9696 majority of the assessed value of the real property in the district
9797 may submit a petition to the commission requesting that the
9898 commission appoint as successor temporary directors the five
9999 persons named in the petition. The commission shall appoint as
100100 successor temporary directors the five persons named in the
101101 petition.

103103 SUBCHAPTER C. POWERS AND DUTIES
104104 Sec. 8342.101. GENERAL POWERS AND DUTIES. The district has
105105 the powers and duties necessary to accomplish the purposes for
106106 which the district is created.
107107 Sec. 8342.102. MUNICIPAL UTILITY DISTRICT POWERS AND
108108 DUTIES. The district has the powers and duties provided by the
109109 general law of this state, including Chapters 49 and 54, Water Code,
110110 applicable to municipal utility districts created under Section 59,
111111 Article XVI, Texas Constitution.
112112 Sec. 8342.103. AUTHORITY FOR ROAD PROJECTS. Under Section
113113 52, Article III, Texas Constitution, the district may design,
114114 acquire, construct, finance, issue bonds for, improve, operate,
115115 maintain, and convey to this state, a county, or a municipality for
116116 operation and maintenance macadamized, graveled, or paved roads, or
117117 improvements, including storm drainage, in aid of those roads.
118118 Sec. 8342.104. ROAD STANDARDS AND REQUIREMENTS. (a) A road
119119 project must meet all applicable construction standards, zoning and
120120 subdivision requirements, and regulations of each municipality in
121121 whose corporate limits or extraterritorial jurisdiction the road
122122 project is located.
123123 (b) If a road project is not located in the corporate limits
124124 or extraterritorial jurisdiction of a municipality, the road
125125 project must meet all applicable construction standards,
126126 subdivision requirements, and regulations of each county in which
127127 the road project is located.
128128 (c) If the state will maintain and operate the road, the
129129 Texas Transportation Commission must approve the plans and
130130 specifications of the road project.
131131 Sec. 8342.105. COMPLIANCE WITH MUNICIPAL REGULATIONS. Any
132132 water, sanitary sewer, drainage, or other infrastructure or public
133133 facilities constructed, acquired, improved, maintained, or
134134 operated by the district shall comply with any subdivision or other
135135 applicable regulations of any municipality in whose corporate
136136 limits or extraterritorial jurisdiction the infrastructure or
137137 public facilities are located.
138138 Sec. 8342.106. COMPLIANCE WITH MUNICIPAL CONSENT ORDINANCE
139139 OR RESOLUTION. The district shall comply with all applicable
140140 requirements of any ordinance or resolution that is adopted under
141141 Section 54.016 or 54.0165, Water Code, and that consents to the
142142 creation of the district or to the inclusion of land in the
143143 district.
144144 Sec. 8342.107. LIMITATION ON USE OF EMINENT DOMAIN. The
145145 district may not exercise the power of eminent domain outside the
146146 district to acquire a site or easement for:
147147 (1) a road project authorized by Section 8342.103; or
148148 (2) a recreational facility as defined by Section
149149 49.462, Water Code.
150150 Sec. 8342.108. DIVISION OF DISTRICT. (a) The district may
151151 be divided into two or more new districts only if the district:
152152 (1) has no outstanding bonded debt; and
153153 (2) is not imposing ad valorem taxes.
154154 (b) The division procedure is prescribed by Sections 53.030
155155 through 53.041, Water Code.
156156 (c) Any new district created by the division of the district
157157 has all the powers and duties of the district and is subject to all
158158 limitations and conditions provided by this chapter.
159159 (d) A new district created by the division of the district
160160 may not, at the time the new district is created, contain land that
161161 is not contiguous to the area described by Section 2 of the Act
162162 creating this chapter.
163163 (e) A division of the district may not occur until each
164164 municipality in whose corporate limits or extraterritorial
165165 jurisdiction the district is located has adopted a resolution
166166 consenting to the division.
167167 Sec. 8342.109. LIMITATION ON DISSOLUTION OF DISTRICT. (a)
168168 Before the issuance of bonds, the district or any new district
169169 created by the division of the district may not be dissolved unless
170170 the dissolution is approved by:
171171 (1) the board;
172172 (2) the majority owner of the assessed value of the
173173 real property in the district or the new district, as applicable;
174174 and
175175 (3) the governing body of each municipality in whose
176176 corporate limits or extraterritorial jurisdiction the district or
177177 the new district is located.
178178 (b) The district or any new district may not be dissolved if
179179 it has outstanding bonded debt unless:
180180 (1) all the property in the district or the new
181181 district is annexed by a municipality;
182182 (2) the dissolution is approved by the governing body
183183 of the municipality; and
184184 (3) the bonded debt and developer reimbursement
185185 obligations of the district or the new district are assumed by the
186186 municipality in whose corporate limits or extraterritorial
187187 jurisdiction the district or the new district is located or by
188188 another entity approved by the municipality.
189189 (c) A dissolution subject to Subsection (b) is effective
190190 when all outstanding bonded debt and developer reimbursement
191191 obligations have been discharged.
192192 Sec. 8342.110. DEDICATION OF AIRPORT PROPERTY. The
193193 district may dedicate, by fee or easement, property owned by the
194194 district for any purposes necessary or convenient for the
195195 operation, use, or expansion of a municipal airport.

197197 SUBCHAPTER D. GENERAL FINANCIAL PROVISIONS
198198 Sec. 8342.151. ELECTIONS REGARDING TAXES OR BONDS. (a) The
199199 district may issue, without an election, bonds and other
200200 obligations secured by:
201201 (1) revenue other than ad valorem taxes; or
202202 (2) contract payments described by Section 8342.153.
203203 (b) The district must hold an election in the manner
204204 provided by Chapters 49 and 54, Water Code, to obtain voter approval
205205 before the district may impose an ad valorem tax or issue bonds
206206 payable from ad valorem taxes.
207207 (c) The district may not issue bonds payable from ad valorem
208208 taxes to finance a road project unless the issuance is approved by a
209209 vote of a two-thirds majority of the district voters voting at an
210210 election held for that purpose.
211211 Sec. 8342.152. OPERATION AND MAINTENANCE TAX. (a) If
212212 authorized at an election held under Section 8342.151, the district
213213 may impose an operation and maintenance tax on taxable property in
214214 the district in accordance with Section 49.107, Water Code.
215215 (b) The board shall determine the tax rate. The rate may not
216216 exceed the rate approved at the election.
217217 Sec. 8342.153. CONTRACT TAXES. (a) In accordance with
218218 Section 49.108, Water Code, the district may impose a tax other than
219219 an operation and maintenance tax and use the revenue derived from
220220 the tax to make payments under a contract after the provisions of
221221 the contract have been approved by a majority of the district voters
222222 voting at an election held for that purpose.
223223 (b) A contract approved by the district voters may contain a
224224 provision stating that the contract may be modified or amended by
225225 the board without further voter approval.

227227 SUBCHAPTER E. BONDS AND OTHER OBLIGATIONS
228228 Sec. 8342.201. AUTHORITY TO ISSUE BONDS AND OTHER
229229 OBLIGATIONS. The district may issue bonds or other obligations
230230 payable wholly or partly from ad valorem taxes, impact fees,
231231 revenue, contract payments, grants, or other district money, or any
232232 combination of those sources, to pay for any authorized district
233233 purpose.
234234 Sec. 8342.202. TAXES FOR BONDS. At the time the district
235235 issues bonds payable wholly or partly from ad valorem taxes, the
236236 board shall provide for the annual imposition of a continuing
237237 direct ad valorem tax, without limit as to rate or amount, while all
238238 or part of the bonds are outstanding as required and in the manner
239239 provided by Sections 54.601 and 54.602, Water Code.
240240 Sec. 8342.203. BONDS FOR ROAD PROJECTS. At the time of
241241 issuance, the total principal amount of bonds or other obligations
242242 issued or incurred to finance road projects and payable from ad
243243 valorem taxes may not exceed one-fourth of the assessed value of the
244244 real property in the district.
245245 SECTION 2. The Hood County Granbury Municipal Utility
246246 District No. 1 initially includes all the territory contained in
247247 the following area:
248248 Parts of the MILAM COUNTY SCHOOL LAND SURVEY LOWER LEAGUE,
249249 the MILAM COUNTY SCHOOL LAND SURVEY UPPER LEAGUE, the JOHN DAVID
250250 CROW SURVEY, Abstract No. 110, the EBENEZER MILLICAN SURVEY,
251251 Abstract No. 414, the J. W. OWNSBY SURVEY, Abstract No. 814, the G.
252252 W. WILLIAMS SURVEY, Abstract No. 600, the JOSE MAYBARBO SURVEY,
253253 Abstract No. 749, the C. C. HARVICK SURVEY, Abstract No. 290, the E.
254254 T. GATLIN SURVEY, Abstract No. 211, the J. W. DAWSON SURVEY,
255255 Abstract No. 805 and the J. H. DAVIS SURVEY, Abstract No. 157
