55 relating to the transfer of certain state property from the
66 Department of Aging and Disability Services to certain community
77 mental health and mental retardation centers.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. (a) The Department of Aging and Disability
1010 Services may transfer to community centers described by Section
1111 534.001(b)(3), Health and Safety Code, and as specifically
1212 designated in Section 2 of this Act, all or part of the real
1313 property as specified in Section 2 of this Act:
1414 (1) including improvements to the property; and
1515 (2) excluding the mineral interests in and under the
1616 property.
1717 (b) Consideration for the transfers authorized by
1818 Subsection (a) of this section shall be in the form of an agreement
1919 between the Department of Aging and Disability Services and each
2020 community center that requires the community center to use the
2121 property in a manner that primarily promotes a public purpose of the
2222 state by using the property to provide community-based mental
2323 health or mental retardation services.
2424 (c) If a community center fails to use the property in the
2525 manner described by an agreement under Subsection (b) of this
2626 section for more than 180 continuous days, ownership of the
2727 property automatically reverts to the Department of Aging and
2828 Disability Services.
2929 (d) The Department of Aging and Disability Services shall
3030 transfer each property by a deed that:
3131 (1) is without warranties regarding covenants of
3232 title; and
3333 (2) includes a provision that:
3434 (A) requires the community center to use the
3535 property in a manner that primarily promotes a public purpose of the
3636 state by using the property to provide community-based mental
3737 health and mental retardation services; and
3838 (B) indicates that ownership of the property
3939 automatically reverts to the Department of Aging and Disability
4040 Services if the community center fails to use the property as
4141 described by Subsection (b) of this section for more than 180
4242 continuous days.
4343 (e) The state reserves:
4444 (1) the state's interest in all oil, gas, and other
4545 minerals in and under the real property described by Section 2 of
4646 this Act;
4747 (2) the state's right to remove from the real property
4848 described by Section 2 of this Act any oil, gas, and other minerals
4949 in and under the real property; and
5050 (3) the state's right to grant a lease held by the
5151 state before a conveyance of real property described by Section 2 of
5252 this Act relating to the removal of oil, gas, and other minerals in
5353 and under the real property.
5454 (f) Sections 533.084 and 533.087, Health and Safety Code,
5555 and Sections 31.1571 and 31.158, Natural Resources Code, do not
5656 apply to a transfer of real property authorized by this Act.
5757 SECTION 2. The Department of Aging and Disability Services
5858 shall transfer to:
5959 (1) Anderson Cherokee Community Enrichment Services d/b/a

6161 Being approximately 0.543 acres of land in Block 27 & 28
6262 (called 28 & 29 in error in prior description), TIMMONS ADDITION,
