77 relating to establishing a kinship guardian assistance program.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Chapter 264, Family Code, is amended by adding
1010 Subchapter K to read as follows:
1111 SUBCHAPTER K. KINSHIP GUARDIAN ASSISTANCE PROGRAM
1212 Sec. 264.851. DEFINITIONS. In this subchapter:
1313 (1) "Kinship guardian" means a relative who:
1414 (A) provides substitute care for six consecutive
1515 months for a child for whom the department had been appointed
1616 managing conservator, but who is not licensed or certified to
1717 operate a foster home, foster group home, agency foster home, or
1818 agency foster group home under Chapter 42, Human Resources Code;
1919 and
2020 (B) is subsequently appointed permanent managing
2121 conservator of the child.
2222 (2) "Relative" means a person related to a child by
2323 consanguinity as determined under Section 573.022, Government
2424 Code.
2525 Sec. 264.852. KINSHIP GUARDIAN ASSISTANCE PROGRAM. (a)
2626 The executive commissioner shall adopt rules necessary to implement
2727 a kinship guardian assistance program. The rules must:
2828 (1) provide for the amount of kinship guardian
2929 assistance payments under the program; and
3030 (2) ensure that the program conforms to the
3131 requirements for federal assistance as required by the Fostering
3232 Connections to Success and Increasing Adoptions Act of 2008 (Pub.
3333 L. No. 110-351).
3434 (b) In adopting rules regarding kinship guardian assistance
3535 payments, the executive commissioner shall ensure that kinship
3636 guardian assistance payments are equal to or less than the monetary
3737 assistance available for a foster care provider caring for the
3838 child for whom the kinship guardian is caring.
3939 (c) To the extent permitted by federal law, the department
4040 shall use federal funds available under Title IV-E, Social Security
4141 Act (42 U.S.C. Section 670 et seq.), to administer the program under
4242 this subchapter.
4343 (d) A person may not concurrently receive kinship guardian
4444 assistance payments under this subchapter and relative caregiver
4545 assistance under Subchapter I.
4646 SECTION 2. Not later than December 1, 2009, the executive
4747 commissioner of the Health and Human Services Commission shall
4848 adopt rules for implementing and administering the kinship guardian
4949 assistance program under Subchapter K, Chapter 264, Family Code, as
5050 added by this Act.
5151 SECTION 3. If before implementing any provision of this Act
5252 a state agency determines that a waiver or authorization from a
5353 federal agency is necessary for implementation of that provision,
5454 the agency affected by the provision shall request the waiver or
5555 authorization and may delay implementing that provision until the
5656 waiver or authorization is granted.
5757 SECTION 4. This Act takes effect September 1, 2009.
