55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to retirement benefits for certain police officers in
88 certain municipalities.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Chapter 451 (S.B. 737), Acts of the 72nd
1111 Legislature, Regular Session, 1991 (Article 6243n, Vernon's Texas
1212 Civil Statutes), is amended by adding Section 14 to read as follows:
1313 Sec. 14. CERTAIN TRANSFERRED PEACE OFFICERS. (a)
1414 Notwithstanding any other law, a member of the retirement system
1515 who served as a peace officer in a municipal department other than
1616 the police department and whom the governing body of the
1717 municipality has transferred to the police department on or after
1818 the member's normal retirement date may, as an alternative to
1919 participating in the proportionate retirement program under
2020 Chapter 803, Government Code, elect to receive a retirement
2121 allowance under this Act while remaining actively employed by the
2222 police department.
2323 (b) If a member elects to receive the retirement allowance
2424 authorized by this section, the allowance must be calculated and
2525 paid retroactively from the date of the member's transfer to the
2626 police department.
2727 SECTION 2. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect September 1, 2009.
