| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 451 (S.B. 737), Acts of the 72nd |
|---|
| 11 | 11 | | Legislature, Regular Session, 1991 (Article 6243n, Vernon's Texas |
|---|
| 12 | 12 | | Civil Statutes), is amended by adding Section 14 to read as follows: |

| 13 | 13 | | Sec. 14. CERTAIN TRANSFERRED PEACE OFFICERS. (a) |
|---|
| 14 | 14 | | Notwithstanding any other law, a member of the retirement system |
|---|
| 15 | 15 | | who served as a peace officer in a municipal department other than |
|---|
| 16 | 16 | | the police department and whom the governing body of the |
|---|
| 17 | 17 | | municipality has transferred to the police department on or after |
|---|
| 18 | 18 | | the member's normal retirement date may, as an alternative to |
|---|
| 19 | 19 | | participating in the proportionate retirement program under |
|---|
| 20 | 20 | | Chapter 803, Government Code, elect to receive a retirement |
|---|
| 21 | 21 | | allowance under this Act while remaining actively employed by the |
|---|
| 22 | 22 | | police department. |
|---|
| 23 | 23 | | (b) If a member elects to receive the retirement allowance |
|---|
| 24 | 24 | | authorized by this section, the allowance must be calculated and |
|---|
| 25 | 25 | | paid retroactively from the date of the member's transfer to the |
|---|
| 26 | 26 | | police department. |
|---|
| 27 | 27 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 31 | 31 | | Act takes effect September 1, 2009. |
