| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Chapter 642, Acts of the 80th Legislature, |
|---|
| 11 | 11 | | Regular Session, 2007, is amended by adding Section 1A to read as |
|---|
| 12 | 12 | | follows: |
|---|
| 13 | 13 | | Sec. 1A. To help facilitate the statewide and regional |
|---|
| 14 | 14 | | goals of making efficient and responsible use of the state's water |
|---|
| 15 | 15 | | resources, the Upper Guadalupe River Authority may contract to |
|---|
| 16 | 16 | | provide any Kerr County entity, and may otherwise use in Kerr |
|---|
| 17 | 17 | | County, water for municipal use under Permit No. 5394A, which was |
|---|
| 18 | 18 | | issued to the Upper Guadalupe River Authority by the Texas Natural |
|---|
| 19 | 19 | | Resource Conservation Commission, the predecessor agency to the |
|---|
| 20 | 20 | | Texas Commission on Environmental Quality. This section supersedes |
|---|
| 21 | 21 | | Permit No. 5394A, and specifically Special Condition No. 5D.i of |
|---|
| 22 | 22 | | the permit, to the extent of any conflict. |
|---|
| 23 | 23 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 24 | 24 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 25 | 25 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 26 | 26 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 27 | 27 | | Act takes effect September 1, 2009. |
