| 24 | 24 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 25 | 25 | | SECTION 1. Sections 502.1725(a), (f), and (g), |
|---|
| 26 | 26 | | Transportation Code, are amended to read as follows: |
|---|
| 27 | 27 | | (a) This section applies only to: |
|---|
| 28 | 28 | | (1) a county: |
|---|
| 29 | 29 | | (A)[(1)] that borders the United Mexican States; |
|---|
| 30 | 30 | | (B)[(2)] that has a population of more than |
|---|
| 31 | 31 | | 300,000; and |
|---|
| 32 | 32 | | (C)[(3)] in which the largest municipality has a |
|---|
| 33 | 33 | | population of less than 300,000; and |
|---|
| 34 | 34 | | (2) a county that has a population of less than 50,000 |
|---|
| 35 | 35 | | that: |
|---|
| 36 | 36 | | (A) borders the United Mexican States; and |
|---|
| 37 | 37 | | (B) contains at least one federal military base. |
|---|
| 38 | 38 | | (f) The county assessor-collector of a county imposing a fee |
|---|
| 39 | 39 | | under this section shall collect the additional fee for a vehicle |
|---|
| 40 | 40 | | when other fees imposed under this chapter are collected. If the |
|---|
| 41 | 41 | | county is included in a regional mobility authority, the [The] |
|---|
| 42 | 42 | | county shall send the fee revenue to the regional mobility |
|---|
| 43 | 43 | | authority [of the county] to fund long-term transportation projects |
|---|
| 44 | 44 | | in the county. |
|---|
| 45 | 45 | | (g) The department shall collect the additional fee on a |
|---|
| 46 | 46 | | vehicle that is owned by a resident of a county imposing a fee under |
|---|
| 47 | 47 | | this section and that, under this chapter, must be registered |
|---|
| 48 | 48 | | directly with the department. The department shall send all fees |
|---|
| 49 | 49 | | collected for a county under this subsection to: |
|---|
| 50 | 50 | | (1) the regional mobility authority of the county to |
|---|
| 51 | 51 | | fund long-term transportation projects in the county if the county |
|---|
| 52 | 52 | | is included in an authority; or |
|---|
| 53 | 53 | | (2) the county treasurer to be credited to the county |
|---|
| 54 | 54 | | public transportation fund if the county is not included in an |
|---|
| 55 | 55 | | authority. |
