1010 Amend H.B. No. 2057 (house engrossment) in SECTION 1 of the
1111 bill, in amended Section 502.1725(a)(1), Transportation Code (page
1212 1, lines 30 and 31), by striking proposed Paragraph (C) and
1313 substituting the following:
1414 (C) that either:
1515 (i) has no [(3) in which the largest]
1616 municipality with [has] a population of [less than] 300,000 or
1717 more; or
1818 (ii) borders another state of the United
1919 States; and

2222 relating to an optional county fee on registration of a vehicle in
2323 certain counties.
2424 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
2525 SECTION 1. Sections 502.1725(a), (f), and (g),
2626 Transportation Code, are amended to read as follows:
2727 (a) This section applies only to:
2828 (1) a county:
2929 (A)[(1)] that borders the United Mexican States;
3030 (B)[(2)] that has a population of more than
3131 300,000; and
3232 (C)[(3)] in which the largest municipality has a
3333 population of less than 300,000; and
3434 (2) a county that has a population of less than 50,000
3535 that:
3636 (A) borders the United Mexican States; and
3737 (B) contains at least one federal military base.
3838 (f) The county assessor-collector of a county imposing a fee
3939 under this section shall collect the additional fee for a vehicle
4040 when other fees imposed under this chapter are collected. If the
4141 county is included in a regional mobility authority, the [The]
4242 county shall send the fee revenue to the regional mobility
4343 authority [of the county] to fund long-term transportation projects
4444 in the county.
4545 (g) The department shall collect the additional fee on a
4646 vehicle that is owned by a resident of a county imposing a fee under
4747 this section and that, under this chapter, must be registered
4848 directly with the department. The department shall send all fees
4949 collected for a county under this subsection to:
5050 (1) the regional mobility authority of the county to
5151 fund long-term transportation projects in the county if the county
5252 is included in an authority; or
5353 (2) the county treasurer to be credited to the county
5454 public transportation fund if the county is not included in an
5555 authority.
5656 SECTION 2. This Act takes effect September 1, 2009.
