55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to annual reporting of women and minority participation in
88 the management and investment of the assets of public retirement
99 systems.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter B, Chapter 802, Government Code, is
1212 amended by adding Section 802.1035 to read as follows:
1313 Sec. 802.1035. ANNUAL WOMEN AND MINORITY PARTICIPATION
1414 REPORT. (a) In this section:
1515 (1) "Minority-owned business" means a business entity
1616 at least 51 percent of which is owned by minority group members or,
1717 in the case of a corporation, at least 51 percent of the shares of
1818 which are owned by minority group members, and that is managed and,
1919 in daily operations, controlled by minority group members.
2020 (2) "Minority group members" includes:
2121 (A) African Americans;
2222 (B) American Indians;
2323 (C) Asian Americans;
2424 (D) Americans of Hispanic origin; and
2525 (E) persons with disabilities.
2626 (3) "Women-owned business" means a business entity at
2727 least 51 percent of which is owned by women or, in the case of a
2828 corporation, at least 51 percent of the shares of which are owned by
2929 women, and that is managed and controlled by women in its daily
3030 operations.
3131 (b) Each public retirement system shall annually, in
3232 accordance with rules adopted by the board, submit to the board a
3333 report regarding the participation by minority- and women-owned
3434 businesses in the management and investment of the assets of the
3535 system. At a minimum, the report must detail participation by
3636 minority- and women-owned businesses, including the participation
3737 of minority- and women-owned financial services firms, expressed as
3838 a percentage of the total assets under management by outside
3939 business entities under contract with the system.
4040 (c) This section does not require a person to disclose the
4141 person's sex, race, ethnicity, or disabled status as a condition of
4242 contracting with the public retirement system.
4343 SECTION 2. This Act takes effect immediately if it receives
4444 a vote of two-thirds of all the members elected to each house, as
4545 provided by Section 39, Article III, Texas Constitution. If this
4646 Act does not receive the vote necessary for immediate effect, this
4747 Act takes effect September 1, 2009.
