55 relating to the designation by the commissioner of the General Land
66 Office of critical coastal erosion areas for purposes of the
77 coastal erosion response plan.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 33.602, Natural Resources Code, is
1010 amended by amending Subsection (b) and adding Subsection (e) to
1111 read as follows:
1212 (b) The commissioner shall publish and periodically update
1313 a coastal erosion response plan. The commissioner shall develop
1414 the plan in coordination with state and federal agencies and local
1515 governments and provide for public input on the plan. The plan must
1616 identify critical coastal erosion areas designated by the
1717 commissioner and prioritize coastal erosion response studies and
1818 projects so that:
1919 (1) benefits are balanced among areas throughout the
2020 coast designated by the commissioner as critical coastal erosion
2121 areas;
2222 (2) federal and local financial participation is
2323 maximized;
2424 (3) studies and projects are scheduled to achieve
2525 efficiencies and economies of scale; and
2626 (4) the severity of erosion effects in each area is
2727 taken into account.
2828 (e) In order to determine which areas should be designated
2929 as critical coastal erosion areas and guide the allocation of
3030 resources, the commissioner may conduct a coast-wide analysis of
3131 the costs and benefits of coastal erosion avoidance, remediation,
3232 and planning. An analysis conducted under this subsection may
3333 consider:
3434 (1) historical erosion rates in an area;
3535 (2) the elevation of an area adjacent to the
3636 shoreline;
3737 (3) the presence of critical infrastructure in an area
3838 adjacent to the shoreline;
3939 (4) the population density of an area adjacent to the
4040 shoreline;
4141 (5) the presence of economic activity conducted in an
4242 area adjacent to the shoreline;
4343 (6) the presence of critical natural resources in an
4444 area adjacent to the shoreline;
4545 (7) anthropogenic contributions to erosion; and
4646 (8) any other factor identified as relevant by the
4747 commissioner.
4848 SECTION 2. This Act takes effect September 1, 2009.
