66 AN ACT
77 relating to the prosecution and punishment of the offense of
88 engaging in organized criminal activity.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 71.02(a), Penal Code, is amended to read
1111 as follows:
1212 (a) A person commits an offense if, with the intent to
1313 establish, maintain, or participate in a combination or in the
1414 profits of a combination or as a member of a criminal street gang,
1515 he commits or conspires to commit one or more of the following:
1616 (1) murder, capital murder, arson, aggravated
1717 robbery, robbery, burglary, theft, aggravated kidnapping,
1818 kidnapping, aggravated assault, aggravated sexual assault, sexual
1919 assault, forgery, deadly conduct, assault punishable as a Class A
2020 misdemeanor, burglary of a motor vehicle, or unauthorized use of a
2121 motor vehicle;
2222 (2) any gambling offense punishable as a Class A
2323 misdemeanor;
2424 (3) promotion of prostitution, aggravated promotion
2525 of prostitution, or compelling prostitution;
2626 (4) unlawful manufacture, transportation, repair, or
2727 sale of firearms or prohibited weapons;
2828 (5) unlawful manufacture, delivery, dispensation, or
2929 distribution of a controlled substance or dangerous drug, or
3030 unlawful possession of a controlled substance or dangerous drug
3131 through forgery, fraud, misrepresentation, or deception;
3232 (6) any unlawful wholesale promotion or possession of
3333 any obscene material or obscene device with the intent to wholesale
3434 promote the same;
3535 (7) any offense under Subchapter B, Chapter 43,
3636 depicting or involving conduct by or directed toward a child
3737 younger than 18 years of age;
3838 (8) any felony offense under Chapter 32;
3939 (9) any offense under Chapter 36;
4040 (10) any offense under Chapter 34 or 35;
4141 (11) any offense under Section 37.11(a);
4242 (12) any offense under Chapter 20A; [or]
4343 (13) any offense under Section 37.10; or
4444 (14) any offense under Section 38.06, 38.07, 38.09, or
4545 38.11.
4646 SECTION 2. The change in law made by this Act applies only
4747 to an offense committed on or after the effective date of this Act.
4848 An offense committed before the effective date of this Act is
4949 covered by the law in effect when the offense was committed, and the
5050 former law is continued in effect for that purpose. For purposes of
5151 this section, an offense was committed before the effective date of
5252 this Act if any element of the offense occurred before that date.
5353 SECTION 3. This Act takes effect September 1, 2009.
