| 9 | 9 | | relating to the issuance of a master electrician license to certain |

| 10 | 10 | | persons performing electrical work in unincorporated areas of the |
|---|
| 11 | 11 | | state. |
|---|
| 12 | 12 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 13 | 13 | | SECTION 1. (a) Notwithstanding any provision of Chapter |
|---|
| 14 | 14 | | 1305, Occupations Code, to the contrary, the Texas Department of |
|---|
| 15 | 15 | | Licensing and Regulation shall issue a master electrician license |
|---|
| 16 | 16 | | to an applicant who: |
|---|
| 17 | 17 | | (1) has owned and operated an electrical business |
|---|
| 18 | 18 | | continuously since 1988; |
|---|
| 19 | 19 | | (2) performs electrical work exclusively in |
|---|
| 20 | 20 | | unincorporated areas of the state; and |
|---|
| 21 | 21 | | (3) pays an application fee prescribed by the |
|---|
| 22 | 22 | | department. |
|---|
| 23 | 23 | | (b) On the request of the executive director of the Texas |
|---|
| 24 | 24 | | Department of Licensing and Regulation, an applicant for a license |
|---|
| 25 | 25 | | issued under this section shall provide the executive director with |
|---|
| 26 | 26 | | detailed information of the electrical work performed by the |
|---|
| 27 | 27 | | applicant. |
|---|
| 28 | 28 | | (c) A person issued a license under this section is subject |
|---|
| 29 | 29 | | to Chapter 1305, Occupations Code. |
|---|
| 30 | 30 | | (d) The Texas Department of Licensing and Regulation shall: |
|---|
| 31 | 31 | | (1) accept applications for a license issued under |
|---|
| 32 | 32 | | this section only between September 1, 2009, and September 7, 2009; |
|---|
| 33 | 33 | | and |
|---|
| 34 | 34 | | (2) publish notice of the application period under |
|---|
| 35 | 35 | | this section on the department's Internet website. |
|---|
| 36 | 36 | | SECTION 2. This Act expires September 8, 2009. |
|---|
| 37 | 37 | | SECTION 3. This Act takes effect September 1, 2009. |
